If I recall correctly in the past Cox priced your internet cost based on whether or not you had Cox TV. Is this no longer the case and cost is the same regardless if you don't want their TV service.

Unless there is some law that says they have to make it available to everyone at the same price because they are a public utility, why would Cox give this up as its their biggest advantage over satellite.

Cox still gives you a price break if you have tv or phone bundled with them in addition to internet, if not you pay the normal price for internet. Mine was a $3 discount on internet when it was bundled with phone service. I switched providers last month, but they still give discounts for bundling services at Cox.
