Absolutely not. Echostar got the USPTO to thoroughly review TiVo's patent. The patent office blessed TiVo's patent as written. They didn't invalidate a single word of it. You are making stuff up.
"The U.S. Patent and Trademark Office (USPTO) issued a ruling today as part of an ongoing patent dispute between TiVo and EchoStar. According to Ars Technica, USPTO made a "final and unappealable decision" that upheld TiVo's 2001 "time warping" patent that allows users to store TV programs while simultaneously watching or reviewing another program (a staple feature for TiVo customers)."

I own 2 Tivo's and (dual tuner model and an HD model) and let me tell you as I'm sure any other owner will. The Tivo devices are far and away better than any DVR put out by anyone, hands down. You just don't see alot of Tivo users on this site. Head over to
TiVo Community
and get a better idea of how popular they are. People like me have them and my main draw is how much I can customize them hardware wise. I'm not locked into anything the manufacturer offers.
I sufferred through a Dish 510, 721 and 522 (yes even the 522 made me upset). Then I used a 622 and it was the closest I got to a tivo experience and honestly, it's not that close, but it's a very easy/friendly interface.
*edit: I almost forgot, I owned a 921 also, since the experience was so bad, I must have tried to forget it.
However, Dish does now have a very good product (much better than directv from what I have seen) and lots of what is in their design you can easily gleen was taken from stuff they saw Tivo's do. I'm not saying they copied, but the ideas and they probably did it a different way to avoid issues.
As far as everyone saying tivo is slow and clunky, sorry, I don't see it at all. My 2 units perform faster than my 721 or 510 ever did.
*Keep in mind, I am a dish subscriber (DishHD only).

I do agree that Charlie should just buy Tivo out. I honestly think that is what they want and possilby are trying to get him to do with these lawsuits and such. End the controversy, get full rights to all the ideas you are trying to re-create and go from there.

It is the patent that TiVo accused Dish of infringing. The USPTO validated it after a year-long review instigated by Dish. It went to trial and a jury agreed that Dish infringed. The appeals court agreed that Dish infringed. It contains both hardware and software claims. No patents held by TiVo have ever been invalidated.

Several people mentioned hoping Dish would buy out TiVo and shut them down. Be assured that if Dish buys them, the last thing they would do would be shut TiVo down. They would start looking at all the other targets that the TiVo patents could be used against. Nothing Charlie appears to like more than launching some lawsuits he could then win.

So you're saying that you can't record while viewing another program with the 622/722? Because that's what the patent is all about.
If they can record while viewing something else, they are in violation, period. That should be easy to check, right?
I just hope they just solve this by paying a license, buyout of TIVO or some other unknown solution. I just hope they solve it, I can't live without DVR's anymore.
