I don't know why Echostar hasn't purchased Tivo, it would fall into lines with their overall plans for the company. Though with their current DVR and the addition of Sling, they can build what tivo has an more. I guess we'll see in a few years how things look.
Maybe you'll start seeing Echostar cable boxes for the local cable companies rather than motorola/??? boxes with Tivo software?[xbl]xRobotChickenx[/xbl]

Is this the part of TiVo's patent that sounds like software?
"32. An apparatus for the simultaneous storage and play back of multimedia data, comprising:
a module for accepting television (TV) broadcast signals, wherein said TV signals are based on a multitude of standards, including, but not limited to, National Television Standards Committee (NTSC) broadcast, PAL broadcast, satellite transmission, DSS, DBS, or ATSC;
a module for tuning said TV signals to a specific program;
at least one Input Section, wherein said Input Section converts said specific program to an Moving Pictures Experts Group (MPEG) formatted stream for internal transfer and manipulation;
a Media Switch, wherein said Media Switch parses said MPEG stream, said MPEG stream is separated into its video and audio components;
a module for storing said video and audio components on a storage device;
at least one Output Section, wherein said Output Section extracts said video and audio components from said storage device;
wherein said Output Section assembles said video and audio components into an MPEG stream;
wherein said Output Section sends said MPEG stream to a decoder;
wherein said decoder converts said MPEG stream into TV output signals;
wherein said decoder delivers said TV output signals to a TV receiver; and
accepting control commands from a user, wherein said control commands are sent through the system and affect the flow of said MPEG stream. "

Sorry, Tivo boy, but the hardware patents are not an issue.

I'll quote the main point for you:
"The latest twist came today when the US Court of Appeals for the Federal Circuit issued a ruling that (mostly) favors TiVo. In a nutshell, a lower court had ruled that EchoStar was violating a series of hardware and software patents held by TiVo. The appelate court upheld that decision insofar as it relates to the software patents. But today's ruling reverses the decision regarding the hardware patents."

You need to get your terminology straight. There is only one patent involved, so stop saying "patents". The appeals court remanded the hardware claims of the patent (singular) back to the district court. Here is what the appeals court said:
"we do not decide what further proceedings, if any, are appropriate in the district court regarding the equivalents issue. Instead, we leave that issue for the district court to resolve in the event that, on remand, TiVo decides to continue to pursue the hardware claims in light of this decision. "

Tivo would be a natural fit for the new Echostar Corporation---The technology provider that sells hardware and technology to anyone. Set top boxes, satellites rental , dvrs, slingbox, etc. Don't be suprised if it happens

DirecTV won't be sued by TIVO as DirecTV still has tons of customers with DirecTV/Tivo units... also DirecTV recently bought ReplayTV and their patents. I don't believe ReplayTV or Tivo sued each other as they both have patents that the other violates thus a no win situation.
