    I dont think so. Like I said before I think the 192,000 exempt receivers it talks about are the receivers that are currently in the field (721, 921, 942 and Homezone1022). So if you had one of those recievers active when the Injunction was ordered it will be exempt and will not be turned off. Maybe I'm wrong but everytime I read the .pdf's thats what I gather.

    The front page news says that all of those receivers have been affected but there's an second PDF that states that only the 721, 921, and 942 are affected. It should be mentioned in the front page news.

    In reading the second PDF.... this seems to be a NON issue.

    "This is a clarification of the "Notice of Tivo Injunction" that was sent this morning. DVR models 501, 508, 510, 522, 625, 622, Homezone 622, and 722, have all received the redesigned software and can continue to be sold, installed and activated.

    With respect to those models, no further action is necessary on your part at this time. However, the 721,921, 942 and Homezone 1022 models did not receive the redesigned software.

    Because the injunction goes into effect today, any existing inventory of those models that has not yet been installed or activated for a customer cannot be installed or activated in the field.

    721, 921, 942 and Homezone 1022 models that are already installed and activated are not subject to the injunction and can continue to be used by customers."

    Dish could work out a licensing agreement with TiVo, or the court could order them to cut them off now. I do not think they can get by with "we changed the code to comply". They would have to get TiVo to agree that the new code does not infringe.

    It is not meant to keep doing new trials to see if new code violates the patents of not. What if they do a new trial on the new code and lose again? Are they just going to say we changed the code again and this time we are sure it does not infringe?

    The 622/722 issues is interesting. They use a different chip set, who knows for sure if they comply or not, but I bet TiVo will be working to get them cut off too ASAP if they think they are the same as the prior ones. But, you would think that since the 622s/722s were out before the trial even started, TiVo would have had the complaint amended at the start to include the 622/722 if they thought they were substantially the same. It is not like Echostar lost the trial and then slapped a new label on an old box and said it was new and compliant, TiVo had plenty of time to bring them to the court's attention.

    The exempt units represent the units that TiVo would have sold with lifetime subscriptions had it not been for illegal competition from Dish. TiVo was awarded one-time payments for these units so there is no award for recurring royalties on this number of units only. It's just a number. There is no particular model number involved.

    It is my understanding that they use the Broadcom chip. Broadcom models were specifically mentioned by that name (Broadcom) in the appeals court ruling as having infringed TiVo's software claims.

    DISH has now begun a hostile takeover of TIVO. This will include all TIVO based DVR's currently being utilized by DirecTV and thus will require D* to turn over (1) of their sattelites for compensation payment......
