Under this amendment, which amends the expiration date of the Development Agreement from February 15, 2007, to February 15, 2010, we will continue to provide maintenance and support for DIRECTV receivers with TiVo service through the expiration date of the Development Agreement. In addition, DIRECTV will continue to have the right to distribute DIRECTV receivers with TiVo service through February 15, 2007, and a related grace period as set forth in the Development Agreement. Further, we agreed that neither party would assert its patents against the other party with respect to each company's products and services deployed prior to the expiration of the agreement, subject to limited exceptions."
Man, you sure are a wealth of knowledge. So if I am reading that correctly, if the agreement expires on February 15, 2010, and one or both parties decide not to renew the agreement, then any DVR deployed after that date that used the Time Warp patent can be considered an infringing unit and then Tivo could sue DirecTV. Anything wrong with my interepatation?

Do you Tivo fanboys even realize this "time warp" thing is ancient past? DISH already said they had a work around on it, you don't have to believe it, but DirecTV is also giving Tivo the finger. Tivo said themselves they lost 518,000 DirecTivo accounts last year alone due to DirecTV switching out the DirecTivo units to their own DVR's. I did not in anyway read in Tivo's 10k any hint Tivo is going to "time-warp" DirecTV into submission after 2010. What you guys just cook up everything in your head to make yourselves feel good?

I have said this, DISH may be bluffing, DISH may not have a work around yet, but DISH seems very confident they have do so successfully, time will tell.

But to think this "time warp" thing is the only way to get DVR going, is just wishful thinking. When DirecTV decided to give Tivo the finger, I am sure they have their legal team looked at the issue carefully. When DISH worked on the new software I am sure they also have their legal team looked at it carefully, they better did so because they had this whole lawsuit as a lesson to do it right this time.

What you guys just want to believe large corporations like D* and E* are a bunch of suicidal morons? Maybe you should send your posts to both E* and D* they will just pay you big bucks to head their legal teams, after all you folks seem very good at knowing exactly what is going to happen.

I used to think some D* fanboys were a little too much, and then began to think some E* fanboys were a little too much, until I meet some of those Tivo fanboys...

So which is it? Make up your mind.

So are we talking about the same legal team that 4 years and 3 months ago decided to drag this out and end up losing?

You are ignoring something altogether. The appeals court remanded the case back to the original trial court on the hardware issue. That court might still find that the hardware also infringes and we all know that a software change does not mean they shipped out new boxes that have not even been invented.

No, I am not a stockholder.
So your investment justifies this sick, perverted behavior in this forum? Obsessive/compulsive posting? An obsession with Charlie that mimics one of those hidden love/hate paranoia things? And the gleeful boast that millions of people could be without DVR service?

All this bravado over a small investment? The fact that you AREN'T a stockholder makes it even more perverse. you gain NOTHING but a sick feeling of satisfaction at the expense of others, condone a rich mans game where everyone loses, and all this over 3500 dollars.

If you have so much faith in Tivo, than invest now...make your millions, and then talk...right now all you do is represent yourself exactly as I had stated...as an over enthusiastic fanboy. Tivo will not go out of business...they will be sold. bought or taken over. Your equipment will be fine. Your fears are misguided...

Dish would say they have a work around whether they do or don't. In any case, they won't get a stay. The judge has already denied a stay.

Point number one: Sick and perverted are not part of the topic, they are instead, personal attacks which are forbidden in the forum rules, punishable by being banned.

Actually, most of this post falls under the heading of personal attack and name calling

    Thomas,

I do agree with you, however, with what is at stake for Dish, I have to believe that it will not come to shutting down the DVR's because Dish will make a deal with Tivo at the last possible minute. Are you saying that you do not agree with that assessment? You seem to be too focused on the injunction.

I should also point out that you have the options of refusing to read my posts, or discussing the topic instead of making personal attacks.. The topic is,

    Notice of Tivo Injunction

    NOT NAME CALLING CENTRAL

    Yet it stands...

...the sick and perverted stuff is consistantly where your posts stray from the topic with bitter invectives. I critique your posts...not you...you're posts are every bit indicative of the behavior I described....

So...care to address my critique of the behavior exhibited in your posts and not avoid it?
