Judge Issues Permanent Injunction
Well the TIVO -vs- Dish Network lawsuit just took another twist as a judge has issued a permanent injunction against Dish Network on their following DVR's...
DP-501, DP-508, DP-510, DP-522, DP-625, DP-721, DP-921, and DP-942
"Defendants are hereby FURTHER ORDERED to, within thirty (30) days of the issuance of this order, disable the DVR functionality (ie. disable all storage to and playback from a hard disk drive of television data) in all but 192,708 units of the infringing products that have been placed with an end user or subscriber."

Well.. this could help in switching/speeding up for an all MPEG-4 system ;0 Charlie would be forced to switch people to a 622 or a 722. I dont see him telling people with these units that they are SOL as far as DVR goes. He will have to replace it with something. God do i hate Tivo and their horrid product not to mention software patents or idea based patents which should never exist. Tivo, please just die in peace.. nobody cares about your garbage product or company ;0

Not without a commitment. If this injunction doesn't get set aside by appeal, Charlie will more than likely offer freebie upgrades. I'm sure there will be a commitment attached.
In one of the documents in the link above it clearly states they can no longer install 942's. The ones already installed are exempt.

No one issued a permanent injunction this past week. The injunction Judge Folsom issued in August, 2006, finally had the stay removed by the Court of Appeals, and is now an enforceable injunction.
DISH/SATS can get into a ton of trouble over this. The injunction went active on Friday, 18 April, and DISH did not shut off the listed receivers in the injunction.

Re: CLARIFICATION TO NOTICE OF AMENDED FINAL JUDGMENT ANDThis is a clarification of the "Notice of Tivo Injunction" that was sent this morning. DVRmodels 501, 508, 510, 522, 625, 622, Homezone 622, and 722, have all received the redesigned software and can continue to be sold, installed and activated. With respect to those models, no further action is necessary on your part at this time. However, the 721, 921, 942 and Homezone 1022 models did not receive the redesigned software. Because the injunction goes into effect today, any existing inventory of those models that has not yet been installed or activated for a customer cannot be installed or activated in the field.
PERMANENT INJUNCTION
721, 921, 942 and Homezone 1022 models that are already installed and activated are not subject to the injunction and can continue to be used by customers.

Ok with the update, this basically means nothing?
IF they are already installed and in service, which nearly ALL of those models would be, then they arent subject to the injunction, correct?
Edit: I see that was sent from DISH to retailers. Not from the courts. Hmmm could get interestingwww. sonicbabble.com The best non sat discussion on the net
