Dish Issues Statement

Tonight Dish Network issued a statement regarding the continuing ongoing lawsuit between them and Tivo. Apparently the Patent office found 'substantial new question' of patentability as to software claims in light of prior patents that appear to render tivo's '389 patent invalid as obvious.

In addition a court has ruled in the NFL Network's motion for a summery judgment against Dish Network. The court denied the NFL's motion for this summary judgment.

Dish Network says they are pleased by the decision and will continue to offer the NFL Network to AT200 and AT250 programming tiers.
