Fox is attacking the Hopper, Sling Adapter and Dish Anywhere now

They lost fighting AutoHop alone so now they are taking the fight to Sling Adapters and "Dish Anywhere". It's funny how there wasn't a problem with DishOnline and Sling Adapters when they were connected to 622's and 722's. Not to mention that I don't remember any lawsuits about copyright infringement and Archeos's PocketDISH. There are no doubts in my mind that this is still a thinly veiled attack against AutoHop and PrimeTime Anytime.

Fox has again asked a California court to block Dish's Hopper DVR, but this time it's not focusing on the ad-skipping function, and is instead zeroing in on new iterations that stream and record programming for Internet, out-home viewing. The programmer maintains those aspects clearly violate Dish's contract with Fox, as well as copyright law.According to a copy of the petition obtained by Multichannel News and filed Thursday (Feb. 21) in the U.S. District Court for the Central District of California, Fox is asking for an injunction against both the Hopper's retransmission of live broadcasts over the Internet to PCs and mobile devices, and the feature that records the programs so they can be transferred to iPads for mobile viewing -- both new functions announced since its initial injunctions were denied last year by the same court, then a federal appeals court.

Doesn't it seem more likely that they'd shut off Fox for Sling and/or blackout certain programs on Fox? Slingbox has been around what, 10 years now? Seems strange that no legal challenges to the technology have stuck thus far and then all of a sudden Fox thinks they can shut it down...

Fox Goes After Dish Hopper -- Again

That's the thinking at Fox headquarters today with the network filing for a preliminary injunction to stop Dish from selling new Sling-equipped Hopper HD DVRs that enable subscribers to watch recorded and live programming on mobile devices.

Bloomberg reports that Fox has filed the preliminary injunction in Los Angeles. alleging the Sling features violate its copyright, and carriage agreement with Dish.

Fox made a similar charge in court last year, seeking a preliminary injunction to block Dish from selling the original Hopper HD DVR which includes a new feature that can automatically eliminate TV commercials during recorded network primetime programming. The judge in that case, however, rejected the injunction request and Fox is now appealing.

And now Fox is seeking a another route to stopping the Dish Hopper with this new injunction request.

"Paying for a satellite television subscription does not buy anyone the right to receive Fox's live broadcast signal over the Internet or to make copies of Fox programs to watch 'on the go' ," the Fox filing states, according to Bloomberg, who adds that a court hearing on the injunction request is scheduled on March 22.



Fox and its broadcast network colleagues, ABC, CBS and NBC, are all suing Dish over the Hopper's ad-zapping feature, but this is the first attempt to eliminate the Sling features.

I agree. It sounds like they are throwing everything at it plus the kitchen sink , hoping something will stick and they can hurt DISH. But what about all the cable companies and Directv that also have Tv Everywhere and do the same thing? Are they going to sue all of them too?

Well if he lives in a market that is being affected by the Grant takedown, then yes, he doesn't have Fox so that's why he can't watch the Daytona 500, since its on Fox.

Could be related to the Sinclair dispute.They own several Fox affiliates.Maybe it's Grant,not Sinclair.

Brother in law is wrong...... No such thing can be done. If Dish is not carrying a local Fox station, then, well, duh....

We don't know what those agreements look like. It may be covered or they may be fighting their biggest fight first. Win against Dish, and then go after the others.

Although I don't agree with Fox on this issue, Dish networks track record of loosing in litigation is an issue that cannot be ignored.

It's very likely dish could loose, and then what do you do with a hopper that no longer works as advertised?

Start working on "Plan B" NOW. Can't imagine Fox will be able to completely make Sling irrelevant though. And that would make for a lot of angry customers with boxes that would be no more than paperweights.
