On May 1, 2003 a press release announcing 42 (38 to go) new TV markets in 2003 was issued.

Retrans. Dispute
Stations marked "Retrans. Dispute" are known to have a retransmission consent agreement dispute with Dish Network. Because the station or station group owners have asked for consideration in return for Dish's use of the station's signal and Dish has declined to "pay" for the signal, the station does not qualify for must carry status. There is always a possibility that one of these stations or station groups could come to terms with Dish Network eventually. Again nothing more should be read into the possible addition of this station to the package.

What Does "Must Carry" Mean?

The FCC implemented a rule as directed by Congress essentially saying that if a DBS Carrier (Dish or DirecTV) carry one channel in a certain city (Designated Marketing Area or DMA), they must carry all the stations in that city. But there are lots of rules that apply to the stations as well. So not all the channels in a DMA qualify for Must Carry status.

In order for a station to qualify for must carry the following conditions must be met:

The station has to ASK for must carry status within the designated election period as established by the FCC. In Boston, the Telemundo station wanted Must Carry, but they asked Dish for it 6 months too late. This station doesn't have to be carried.
The station MUST be an FCC licensed full-power station to the DMA in question. Licensed low power channels and Class A Stations DO NOT qualify for must carry status. Stations licensed to foreign countries (Canada - "c" stations and Mexico "x" stations) DO NOT qualify for must carry status.
The station may NOT ask for any consideration or compensation in return for allowing the satellite company to carry the channel. If a station asks for ANYTHING it waves its right for must carry status until the next election period (usually 3 years)
The station may NOT be a repeater or substantially duplicate another channel's programming within the same DMA unless they are in different states. This means that if there are two channels in the same DMA that mostly show the same programming at the same time and are both in the same state, ONLY ONE has to be carried under the must carry rules. But if the two stations are in two different states, BOTH have to be carried under the rules if they ask.
The station MUST provide a "good quality" signal to the satellite company's local point of presence (POP). "Good Quality" is subjective and the FCC has been involved in a few disputes, but if a station's over the air signal is not satisfactory, the TV station must provide their signal via fiber or other conveyance at THEIR expense.
Non-commercial/Educational stations (PBS and EDU) have different but similar rules

Any stations that do not qualify for, or waive must carry status or elect retransmission consent COULD be carried by retransmission consent between the station and the DBS Carrier, but the stations that do not qualify for must carry cannot force the DBS company to carry the station.

Dish Network Satellite TV Names 42 New Local Channel Markets for 2003

ATLANTA--(BUSINESS WIRE)--May 1, 2003--

  With New SuperDish Technology, DISH Network Plans to Deliver Local
     Channels Via Satellite to 106 Markets Nationwide by Year End

EchoStar Communications Corporation (Nasdaq:DISH) and its DISH Network(TM), a leading provider of satellite television entertainment services, announced today 42 new designated market areas where it plans to launch local TV channels, provided retransmission agreements with local TV stations can be formalized in each of the markets.

This will bring the total number of markets DISH Network serves with local channels to 106 by year end. DISH Network is also announcing that it plans to offer local channels via satellite in more cities across the nation by end of 2004. Today, consumers have a choice of receiving local TV channels from DISH Network in 64 U.S. cities.

EchoStar Chairman and CEO Charles Ergen is making the announcement at DISH Network's annual Team Summit satellite TV retailer conference here where more than 3,000 attendees gathered for seminars and workshops about new DISH Network products and services.

Customers in these 42 new markets will require the use of either DISH Network's existing DISH 500 antennas or its new SuperDish, a multi-satellite dish unveiled to satellite TV retailers today. The SuperDish, an elliptical 66-centimeter dish, is capable of offering customers access to hundreds of popular DISH Network channels, local channels in new markets, HDTV channels and international programming. The SuperDish will be capable of receiving satellite signals from three orbital locations.

"DISH Network continues to seek ways to expand services for its customers and increase competition to cable," said Ergen. "By expanding our delivery of local channels into more markets, DISH Network will provide consumers the opportunity to subscribe to a service that is less expensive and of better quality than what the dominant cable companies provide."
