About the VOOM comercials on TV

I've seen this ad on fox, ESPN, CBS, NBC and ABC and found something kinda weird and funny at the same time. The VOOM ad says VOOM has 39 HD channels. I counted them and they only have 36 HD channels. So why would the ad say 39?

Technically, VOOM has 37 HD channels if you count 999 (which was showing live feed from DNC and RNC, not just a Barker ;)). HD channel #38 is/was RSN Florida. And there was only one moment in time when VOOM had all 39 HD channels: it was during the Olympics, when they had NBC-HD. Of course, even then most of us were not able to receive all 39 at once, due to regional restrictions...

As for the ad, I haven't seen it, but if it does state 39 currently available (not "up to 39"), that would be misleading, I agree.
 
yeah it's 37 HD channels but it still doesn't makes sense that the ad says 39HD channels. That's kinda false advertising. The ad has dirtbikes in it. It doesn't say up to 39 HD channels, it says it has 39 HD channels.
