EchoStar Loses Distant Network Appeal

Walt this thread keeps going to USA vs. Canada
this thread is intend for dish net potential loss of dns due to the action the company took
i feel as I'm sure other members do as well political views belong in the pit

Dish intentionally did not follow shriva for one reason or another now us customers will suffer

For crying out loud Phillips, give it a rest. It's not THAT far off topic - if at all.

If you think Shvia, SHVERA, copywrite laws and court rulings are not affected by politics, you're being a bit niave. They do and therefore have everything to do with the the topic of this thread.

That said, I'm not arguing that Dish hasn't or isn't screwing their customers with some of this.

Obviously our posts crossed.

For a lot of us in the Northern states, Canada does have a lot to do with things. Where I am in Vt, our LiLs are not even doing digital yet and their analog is not receivable in much of the state. NH has only one affiliate in the whole state. I expect there are similar situations on down the border.

My point is in the context of Dish loosing distants and Canada being more liberal about how they distribute nets, it is relative information to many of us.
 
i know that they are affected by politics walt but not in the usa vs . canada sense
fact of the matter is shreva was not followed completly by dish.
show me where shreva deals with issues like this

Sure, Canada has their free-market, capitalistic tendicies. But the Canadian government is much more involved in running businesses than our government here in the US.

I can somewhat see your point but that post, when taken by itself, is a bit out of context. I think Greg was just trying to qualify some of his statements in his previous posts.

Now, let's go to the methods of qualification, that seems to be DirecTV's policy:

1) Are we serving you local channels? About 95 percent of the households in the US can receive local channels. Distant locals are now only available for the other FIVE percent.
2) Are you in range of local broadcast towers, with a Grade B signal or better? I would suspect that a large percentage of households are within range.

Per DirecTV policy, you'd be lucky to qualify for distant locals now.

You may have a better chance of winning the Pick 4 on any given day.

Walt i agree with you here I too am iin a northern state MN in our state it seems the only lil market that has made any progress is Msp and there are more markets in Mn than just duluth or msp
MN should have more than one tv market there should be at least 4
duluth has no hd that i know of so eventhough they are functional with the big 4 none are hd
i agree canada is far more liberal in distribution of networks thats a damn good thing.
so i too am very interested in this issue but my arse regarding dns is covered via dtv bell and starchoice

so dish did not follow the rules and us customers will be the one to lose

given dtv's qualifications it is extremly easy to qualify for dns imho
periodically i move back and forth between a grade b area for all 4 and a instant qualify for all 4 due to no signal at all
when i move back to my grade b area i still get dns+hd dns(east)+ota
the dns doesnt auto drop as it should when im in my grade b area

I may have misunderstood youre posts earlier as i have a tendency to skim threads rather than read word for word

if dtv can follow shreva there's no reason dish could not.

i once and still am labeled a security risk by dish for adding dns via web to my account i added all 5 dns cities audit team found out and i was fined $197.00 for unlawfully having extra 3 dns markets, now i come to find out its dish who didn't follow the rules and i paid the penalty and i am irate about that.
ever since they labeled me a security risk i have no access to the dish site
i paid for their messup and still am as i cant access their site.
audit team members changed my login details admitted to me by the respective members
Why, must i have a penalty for their screwup?
bs.

customer's foot the bill for dishes intended screwups ala the dns issue currently

The idea that information can be owned is ludicrous. Though that is outside the scope of this argument. However, if we had a more rational approach to such things, issues about "distant networks" would never come up.

Does this involve calling DirecTV and changing addresses? Also, are you "grandfathered", or did you originally setup your account in a "white area"?

Boy, did Dish Network screw that up! Dish Network should not have forced you to pay a penalty; you weren't the one that messed up. You could always send that notice to the NAB. They'll love you for it.

yes when i move i call, as for your advice i think i may persue this issue with my penalty for dns with dish further

just goes to show the only one this will hurt is the customers not dish.
if dish does get fined look for the package prices to raise yet again

does this dns in any way affect sv channels?

Do you still think this will also kill the Dish CBS HD feed or any potential future feeds of the other 3 Nets in HD? Or was it Tony that thought that and you didn't agree with him. Shoot - can't remember now. Anyway, I'm wondering if this "45 day" thing has something to do with that.
 
I am the one that believes Dish Network will no longer be able to sell distant HD service. As of right now, it only affects CBS, as CBS is the only net offered as a distant. If an injunction comes to pass, it will definitely affect any future HD distant network service offerings.

The "45 day thing" is a Congress representative asking the broadcasters in the suit and Dish Network to try to come to an agreement. The broadcasters hold all the cards. I would believe any settlement out-of-court would have the broadcasters require Dish Network to cut-off all ineligible subs. But knowing how Charlie Ergen operates, I'd suspect he'd tell the broadcasters he doesn't have any ineligible subs.

I believe this one will be a shell game. Mr. Ergen probably believes there will be a lot of outrage, so he thinks he is bargaining from a good position. He'll be telling the broadcasters that you don't want to irk all these customers; you never know what Congress will do. Of course, that puts the customers in a game of brinksmanship, and we all know that Dish Network won't hesitate to use their pawns... I mean customers in a negotiation.

on the contrary, i think he is sorting through all the subscribers right now. my RV waver had to be updated with a new form just out this April. and he will probably cut the ones that are not in the clearer right to get them. i think that's why the audits are so bad this year. and the rest will be about how much they want to grant him the service rights. I'm shire hell pay a lot more now than if this hadn't gone so far.

Let me try this the easy way...

A court of law has been compelled to issue against Dish Network a permanent injunction on the use of the distant network service license. If the court issues the injunction, distant network service goes away for everyone.

So, your statement that "he will probably cut the ones that are not in the clearer right to get them" is misleading. The courts will be the ones to cut off ALL distant network subscribers on Dish Network, unless...

Dish Network can somehow come to a settlement of the case with the broadcasters. I just don't think Dish Network will settle.
