EchoStar-Rainbow

Scott,

I'm not trying to bust your chops, but it really did need an edit.

Remember, a lawyer will tell you about legal problems, that's it.

Did he really tell you the text was "find" ;)

Cheers,

Yep, I haven't given it too much consideration, but here are my signal levels under cloudy skies in VA:

Rainbow-1
TP1 - 104
TP3 - 105
TP5 - 105
TP7 - 103

E*3
TP18 - 110
TP20 - 115
TP22 - 114

Well, wtf...

Mine are 25 or 30 lower - and apparently Goalie Bob's are too.

Are the coverage map for Rainbow and Echostar the same in terms of strength?

I believe the FCC is holding up the sale approval to try to ensure the long term continuation of Sky Angel/Dominion. This would require that Dish and Dominion reach a new agreement that extends beyond the life of the E-3 satellite. The FCC can argue competition but also recognize that Dominion has some extraordinary political sway with the current administration. Dish has a great deal of motivation to make a new deal regardless of the recent legal conflict with Dominion. Besides wanting approval of the sale sooner rather than later, the other factor is at least one of the two unlicensed TP frequencies specifically TP 23. If Dish plans on using the R-1 spotbeams to their fullest capacity in the future, TP 23 is used in 11 different R-1 spotbeams. Even if Dish decides not to use the 5 western U.S. spotbeams because of look angles, TP 23 is still used in 9 different spotbeams. This is significant capacity. In comparison Dish's spotbeam satellites at 110 and 119 each only have 25 spotbeam TPs total.

But why delay things? A 15 minute conference call could hammer out any issues and conditions. This is hardly a "complex" deal (The FCC site says that they should take no more than 180 days with only "complex" deals taking longer).

There is no good reason for this to be taking so long.

I think i know whats going on here... today the ffc approved D*'s sat to be moved.. but yet they cant make a 15 min desion. to approve the transaction of rainbow 1... Ruperts got a hand in this.. but thats my opinion

OK this is getting ridiculious. The FCC is blowing me and everyone of us off. It is time to take action and go above the FCC.

We must contact Congress members who sit on the Commerce Committee. They can truely get an answer from the FCC. They oversee the FCC to some extent.

Here are contact numbers of the members on on the committee:

Of course he has. He has for a while now. If you look back durning the year prior to the passage of the Dec-'04 legislation, when Dish, the DTC (I Want My HDTV) and many of us were pushing like heck for the right to provide DNS & define a digital white area and all that. Well "D" was unusually silent about it all. They wern't part of the Digital Transition Coalition and I'm almost thinking they released a statment that kind of distanced them from the whole business.

Well when the '04 Shvera passed it didn't define any white area and basically put "E"s plans of putting up the big 4 in HD on hold for a while (unless they wanted to follow the same method as "D").

I believe the plan was this:

"D" would basically not support any of the DTC lobbying and even make it very difficult for their own subs to qualify for their DNS (numerous threads support this). This made the NAB very happy.

In exchange for this, the legislation would be written in such a way (without being obvious) that not only hurt "E"s plans of "immediatly" putting up the 4 DNS (like they had been saying they would do all Summer) but also saddle them with the "one dish" for LiLs deadline.

The strategy of all this was to give local affiliates more time to upgrade and Direct Tv time to get the jump on "E" for HD LiLs.

What was not taken into account were delays in "D" getting satellites launched, "E" putting Voom channels up and the "E" Rainbow-1 deal.

If I really want to go out on a limb, I'd say that the vaselating "D" has done on it's qualification proceedures for their DNS has been a product of getting the FCC to delay as long as possible on the Rainbow-1 approval. If you reseach the numerous threads related to people qualifing for "D"s DNS, you'll find at first it was very difficult - almost no one got them; then for a while it seemed "D" relaxed a little and then it seemed to get tougher again.

I think Dominion's letter filed in June 2005 pointed out the fact that the FCC made a ruling that a sat company with a conus slot cannot bid on the remaining frequencies at 61.5. Rainbow did not have another conus slot and was eligible for the 61.5 freqs. E* has conus slots and is not eligible for the 61.5 freqs.

Dominion may be just bluffing in stating they are planning launching a sat for 61.5. In actuality, they may just be trying to preserve any future expansion ability on their behalf.
