EchoStar sues TiVo, Humax for patent infringement

TiVo Inc. and Humax USA Inc. are at the center of a patent infringement lawsuit being litigated in Texarkana, Texas.


EchoStar Technologies and its lawyer, Damon Young, believe TiVo and Humax had four different patent infringements, according to the lawsuit filed in federal district court in Texarkana, Texas.



EchoStar's subsidiary ETC is the leading provider of satellite-delivered digital television to customers in the United States through its subsidiary DISH Network.


"The DISH Network's services include hundreds of video, audio and data channels, interactive television channels, digital video recording, high definition television, international programming, professional installation and 24-hour customer service. ETC supplies satellite receiver systems and designs and develops set-top boxes, antennae and other digital equipment for the DISH Network," according to the lawsuit.



In count one, TiVo and Humax USA allegedly infringed on ETC's 1998 patent "Interruption Tolerant Video Program Viewing."




"On information and belief, TiVo and Humax USA are making, using, offering to sell, selling ... personal television services in the United States of America," according to the lawsuit.



The second alleged patent infringement claim is for violation of ETC's 2003 patent "Multimedia Direct Access Storage Device and Formatting Method."


Likewise, ETC officials believe TiVo and Humax USA violated a similarly named patent granted in 2001.



The fourth and final count in the lawsuit is for the alleged patent violation of ETC's "Method and System for Recording In-Progress Broadcast programs."



ETC wants the alleged infringements to cease.



It also seeks compensatory damages and triple damages for the alleged violations.
