HD TIvo for OTa recording only?

I know I may have seen the answer to this somewhere, but I couldn't find the answer anywhere after I tried many different searches. Is it true that my HD Tivo will only work if I have at least their minimum package (total choice)? Or can I just pay them the DVR fee if I discontinue service? I guess I could always just called them and ask that...

to answer my own question (I called them!) I gotta have at least a minimum package. but I was able to get them to give me a "total choice select"; which is lite version of the total choice (90 channels) for $35./month. I was also surprised to find out that they now claim that my commitment is for another 13 months!! long story...
they tried to give me another HD DVR for 270 bucks, which I passed!

isn't there a family plan for less than 35 also?
