Does the FCC prohibit VOOM from adding OTA channels to your map?

Hi:
I wrote to VOOM support last week to ask how to get program guide information for new channels found by the OTA scan and I got the following response. I had never heard of this and I wondered if anyone knew the particular FCC regulation that VOOM would be violating by adding channels to my map?

I apologize for any inconvenience that this issue has caused you. You will only receive a program guide for local channels that the system is mapped to receive. The mapping of local channels is determined by zip code according to the FCC and cannot be changed. What our firmware download did was improve the scanning ability of the VOOM system. In your case you are scanning more channels than the system is mapped to receive. As you have said you get sound and picture but no program guide information. Unless the FCC upgrades the mapping in your area you will not get a program guide for the extra channels the system is now scanning. Once again thank you for contacting VOOM.
