Fox Sues Dish Over Ad-Skipping Auto Hop

Haha in reading the FOX lawsuit they are suing over PrimeTime Anytime calling it a "bootleg video on demand service"

Its not a VOD service, its a DVR. Its NOT enabled by default and like AutoHope it needs to be enabled by the customer meaning that the customer wants to record those shows on their DVR.

What a funny read so far!

They act like they just heard about this and are rushing to come up with some stuff to tell their lawyer and the press.

Hey if Fox wins this one then I think I should be able to sue SatelliteGuys members who use an ad blocker here. (I kid of course!) But honestly the ability to skip ads on TV or on forums has been around for years... get over it folks the genie is out of the bottle. :D

I wonder if FOX is going to sue Microsoft as well since using Windows Media Center I can record network show and have it auto skip ads as well. Hell WMC has has this feature for years!
 
I have been skipping commercials automatically for a while too with BeyondTV. Hell even with my first QAM tuner card I would run HDTV2MPEG on the TS files. I would break out ABC and CBS from the same stream and actually delete the commercials automatically before watching the show.

Dish was just the first one to bring it to the masses...replaytv kinda brought it but not as big as Dish did. I have to give them a congrats on that one.

Yeah, reading the complaint it's not really about auto-hop at all, but that PTAT is a VOD service, not a user DVR feature and violates the VOD portions of the license agreement.

If Dish combined partitions, threw in a few checkboxes for what stations/hours to record it would undercut a lot of the complaint.

Even then its not a real complaint since the user must enable PrimeTime Anytime, saying they want to record the big 4, its not a feature which is enabled out of the box.

If PTAT was enabled by default they would have a complaint, but its not.

Oh, don't misunderstand, I think it's a stretch too. Just pointing out the actual suit has very little to do with auto-hop specifically. If they thought auto-hop itself was an substantial copyright issue, I think it would have been singled out more.

The Fox case is by far the best written. Its design to get the courts attention and rush this through.

I agree the Fox complaint has some valid points. DIsh just needs to add a few check boxes making it more like DVR recording options of today and they are covered. As for Skipping commercials, that all depends on the retrans contract which we cant see. Maybe down they road the networks charge $1 per network more for skipping commercial and they cant charge Dish anything for re trans if the customer is to not skip commercials like as if they got it over the air for free or under must carry,

Either way DIsh proactively suing the networks now is the right thing to do as it will cause the courts to answer these question on re trans cost vrs watching commercials now.

While the court is at it, why dont we sue to make it so I can watch ANY Network station from any City IF I pay extra for it. The networks can again make more money.
The whole DMA market map thing needs looked at again, its from the 60's
 
Reading that brief made me laugh. PTAT is a DVR function. User enabled, uses a tuner, and records content for later viewing. The VOD argument is a complete joke. PTAT content isn't delivered to the Hopper via A sat download or via Internet download, a DVR recording is made. They say that Dish has not availed itself of Fox's VOD offerings, but is in breach by offering VOD commercial free? So if Dish just made Autohop universal to all DVR recordings they wouldn't have any problem with it, because DVR use is fine and it's the VOD part that is the problem? Yeah right, that's believable. And somehow, Sling is suddenly problematic? So I can't watch content I've paid for and chosen to have my DVR record? Fox has lost its mind.
