TiVo's battle with Dish to end in spring: TiVo CEO

NEW YORK (Reuters) – The legal battle pitting TiVo Inc against EchoStar Corp and Dish Network Corp will be decided in February or March, TIVO Chief Executive Tom Rogers said on Tuesday.

The closely watched battle dates to 2004, when TiVo accused satellite TV provider EchoStar's Dish Network system of violating TiVo's patent for "Time Warp" software that allows users to record one TV program while watching another. EchoStar has already paid TiVo a total of $104 million in damages.

"We look at the Dish litigation as something we're going to win," Rogers said, speaking at the Goldman Sachs Communacopia conference in New York.

He added that should the company come out on top, it would likely invest the winnings in research and development.

The U.S. Court of Appeals for the Federal Circuit has agreed to hear the case en banc, which means the full panel of judges, on November 9.

TiVo shares fell 10 cents, or 1 percent, to close at $9.71 on Nasdaq.

Heh, why ? Would the boss of TiVo say anything else ? Dish will release a statement soon countering it, saying "We are confident that the appeals court will rule in our favor..." blah, blah, blah.

Not quite yet. The PTO is in the process of invalidating the software claims of the '389 patent. Tivo has the right to appeal to the court system though. So the process is far from over. The En Banc hearing is the main hope for E* right now.

There are still numerous steps being taken regarding claims 31 and 61, which were invalidated by the PTO. Long story short, although the PTO has invalidated the claims, it is not quite a final action, so TiVo can tie the matter up in the courts, while the patent would still be considered valid.

TiVo is changing their business model from buy the hardware and subscribe for service to subscribe to service and the hardware is "free."

Looks like TiVo is (still) in trouble.

Aha ha. So that's why the Tivo Premier shipped in the state it is in. Some people here want to complain about the 922, but at least DISH didn't screw that launch up as much as Tivo did theirs!

And come on. Who asks that kinda question? It's like being a "man on the street" asking the hobos what they would do if they won the lottery!
