Week after week, month after month, year after year, it is hard to remember a time during which Dish Network was not participating in a high-profile lawsuit or legal dispute. And when two individual federal judges, in separate cases, question whether a company remotely cares if it is violating the law — any law — it is far more than business as usual. Could it be that a reputation for not caring about the law, or the rules, or core corporate ethics has enveloped Dish Network and is catching up to it?

Charlie is a world-class poker player. He gambled on everything all the way up, and became a billionaire as a result of it. People like that get their kicks from the adrenaline rush of beating an opponent.

It doesn't matter if it's poker, starting and running a business, or a court battle. I'm sure they are all very personal to him, and he'll never stop as long as he breathes.

Regardless of all this, IMO there has been some real good for all of us that's come out of the fact that Echostar and Dish Network exist. Maybe that won't continue, but we'll be there to see it in whatever happens next.

Charlie thinks himself and Dish is above the law.

I think Charlie has a ranch in the middle of several other ranches with no access to the road. Charlie fought the other property owners to the point where he wore them down so he could build a road across their land to get to his property.

There is no regard for anything with Dish, they just do it and if they get caught cry like a kid who got his hand in the cookie jar.

Here is one nobody knows about. Back in 1999 Dish acquired the 110 slot but had no satellite.

At the time they had a satellite (echostar 4) at 148 that was being used for international programming.

Dish decided to move echostar 4 to 110 which created an issue with customers who where getting international programming from 148.

So over night Dish crammed all the programming from the 148 orbital slot to the 119 orbital slot.

This took care of most customers who had a 119/148 Dish setup.

Then over the next few weeks repainted all the customers who only had 148 to 119.

What Dish did not tell anyone is that they used the 11 extra transponders at 119 that where not being used, but owned by Primestar.

Dish illegally used transponders on 119 that they where not licensed to use or had ownership of.

Perfect example how Dish feels they are above the law

I do not know how it is in Michigan where you live, or the State where Charlie has the ranch. But in Alabama he would be well within his right to "fight" for access to his land. In this State, you have to grant an easement for access to property that doesn't connect to a public road in order to give the land owner access to his property.

Michigan is the same, only you have to go to court to get that easement (unless they will sell you an access easement). Once you do though, they MUST grant it if there's no other access. http://olcplc.com/public/property-easements
Easement by Necessity
Michigan law recognizes a special easement which is created by an imposed court order, often times against the will of the neighbor. This easement, known as an easement by necessity, is imposed typically only when no other option is available. A common example is truly landlocked property. However, the need for such access must be extremely high. As the courts have explained, "mere convenience, or even reasonable necessity, will not be sufficient if there are alternative routes, even if these alternatives prove more difficult or more expensive." Courts will routiuely not grant such an easement when there remains any possible way to access a public roadway.

I once owned 20 acres of a nice land-locked property on an island in Lake Michigan. I was going to go through this process, and ended up trading another owner my 20 acres, for his 10 acres ON THE ROAD. He was one of the island families, and got access to the 20 through one of the family properties on the road.

I believe that it is the same way here. If you can't work out something with the land owner, between the two of you, or your attorneys', then you have to go to court to get the easement.
At any rate, I do not know any of the specifics in Charlie's case, but from what Claude posted, seems to me Charlie was well within his right to get access to his property.

Exactly right. If you buy land that is land locked you usually have the right for an easement to the property. Charlie had every right to do that.

I'm not sure I get the hate here. I hope any of the people that are being judgmental towards him about this are just as judgmental towards our President because he has an even worse history when it comes to this type of business.

Nothing personal, sorry if it did sound that way.
Just a fact that a certain member does have a vendetta based on his own personal circumstances.

Can you really blame him? Dish did that and screwed him out of well over a million dollars they clearly owned him! I don't think I would ever get over that type of bitterness my whole life.

Actually, I think Claude has been very restrained compared to that sort of betrayal.

When it comes to allegations like Claude has made towards Dish I can't side with anyone until I hear the entire story from both sides. Since I can't get Dish's side of the story it's hard for me to believe 100% of everything Claude says. I believe he has a legit issue with Dish but it also wouldn't surprise me if he embellished the story a bit as well.

Listening to both sides of the story is the surest way of learning that there's more to a story...than both sides.
