I think this really is an issue that could find Comcast in violation of federal law, regardless of what various state deregulation efforts have done to change the rules. PEG programming is clearly intended to be available at the most basic level of service available. If Comcast was to make this move, say, 5 years from now, when most people have upgraded to TVs, VCRs, DVD Recorders, etc - which all have Clear QAM, and Comcast commits to broadcast PEG channels in Clear QAM, with no specific authorization required, just as DTV locals must be in Clear QAM - then it would make sense.
