Switching from AT&T billing to dish...

Okay guys, here's a question for you. I'll start with a little history, though. My dad moved (literally) across town a couple of years ago. At the time he was a dish customer. They were trying to penalize him for moving, saying he was breaking his contract. Long story short, he wound up switching his billing to AT&T, and started over as a new customer, got free receivers and all that jazz. Presently he has the same hardware, and his HD setup only gives him like a handfull of hd channels, and no dvr. Could he switch back to Dish billing and be a "new" customer, thereby upgrading for free? I suppose this is somewhat shady, but so is the way dish treats existing customers.
 
I've been told by serveral DISH csr's that to be considered a "new" customer is not to have DISH service for over a year. No service for over 180 days and returning you are considered a "returning" customer an you don't get any reactivation fees waived.
