Dish HD vs Disney (DISH sort of won...)

I can most definitely believe that. It's just that when I watch other channels on dish they do look good. I have never had the luck of seeing FIOS or OTA. I prefer Dish for i like their DVR better than the Motorola box that FIOS offers. Plus the programming.

This thread has started doing strange things... for example at the moment I can't read the last post.

I am investigating and if needed I will close this thread and open a new one to continue discussion.

Sorry for the issue!

It's just too bad that ALL the providers can't deliver the quality of the originals. I really think if they all could find a way to do that it would make many people very happy :) It's such a treat to see the originals when they are open. You don't need 3DTV since it has that 3D look already.

They can, it's called getting rid of all the fluff channels that only show 8 hours of programming and 8hrs of paid programming running in a loop. We don't need 6 different versions of Disney or Nick or Mtv etc.... Do that and there is plenty of bandwidth to show the remaining channels at a very good and stunning bitrate.

Good Luck, Everyone wants another HD channel added daily.

There was an appeals court ruling in E*'s favor that the original court may have misinterpreted the intent of the "Most Favored Nation Clause" in the contract. That is why the case was sent back to the Court for a re-trial.
Here is a link to a post about the appeals court decision.

Does anyone know when this case is set for a hearing regarding the re-trial in the original court??

Anyone know when to expect another Judge's ruling regarding this lawsuit?? Wasn't really sure what the next step was as far as getting these channels returned to Dish programming. I know that Scott mentioned that he had a gut feeling that it could be January if I remember correctly.

From the wording of the ruling, and the fact that is was made by the Manhattan Supreme Court, it looks like it will be a long ride while Dish takes this through the rest of the process in the Courts.

It also shows the pure greed of Disney and the fact that they want to screw the American Public for every possible penny!

So I get that Disney is entitled to that $56 Million, but what does this mean about the 4 Disney/ESPN HD channels? Are they going to be coming back soon or are we never ever going to see them again?

It will just be refiled in the Federal court. I don't think this is over by a long shot. It will hurt us all if we have to pay for the same channel in twice. Once as SD and once as HD

This needs to be fought really hard by Dish. If Disney wins the issue of paying twice, once for SD, and once for HD, will be mirrored by everyone and we are all SCREWED big.

A win in Federal courts by Disney will mean that every other major content producer will follow the Mouse with baseball bats that are not greased up with vasoline and impale every one of us.

If we have to pay for SD and HD then I say Dish says to Disney to keep your SD and just pay for HD. That's what the consumer wants anyways.

IF this sets a trend and all the companies decide to double charge for their channels , then I can see an end to FREE HD for LIFE! at DISH. Along with me cutting out Satellite entirely. I refuse to pay twice for watching only HD channels. The price of satellite and cable packs are already Too damn HIGH now.

Disney countered that the contracts explicitly required Dish to pay an extra fee for the HD channels, which it argued were separate networks and not merely feeds of a standard definition network.
I'd like to see the slick lawyer double-speak that convinced the judges that two channels with the same name, the same content, and the same schedule just that one of them has the letters H-D after it's call-sign are two separate channels. :facepalm
Perhaps it had something to do with the way the contract between DISH/Disney are worded? I would hope that language isn't standard for DISH's other carriage agreements.
