DISH Reaches Long Term Agreement with DISNEY / ESPN / ABC

But in addition, Coke isn't in the position to make a demand, they are vying with Pepsi to be seen/used by a client. The Client (Dish as the correlative) holds the cards in your scenario. Coke would simply be negotiating if we pay X we want y. The client if they did not like that could go to Pepsi, Dr. Pepper, whoever and see if they can get a better deal. In Hollywood you can be turned down for employment or terminated because you are not pretty enough or have gained too much weight - or are too pretty. Firefighting among other industries have some accepted work rules that would not be accepted in other industries.

Your analogy is completely wrong. Coke would be the local NBC affiliate and Pepsi would be the local ABC affiliate. They are not interchangeable products (just like the networks). Dish is the store selling to consumers. Coke and Pepsi tell Dish they will sell them their product directly for $X.XX (making Dish an authorized retailer of the product), but as part of that agreement Dish has to promise not to get their Coke and Pepsi from an unauthorized wholesale source (Aereo). There is nothing illegal about such a contract. And, as such, it's not clear to me that any such demands will trigger a DOJ anti-trust investigation.

Aereo probably would love to be able to offer cable channels. They do offer one (Bloomberg TV). But as long as the big 4 are suing I bet there will be very few takers.

Notice as soon as someone else gets a better deal, "DISH" (In place of the Grocery Store selling to consumers) can tell them they will not carry some "Channels." (Products) It's Coke and Pepsi competing against each other for "Satellite Space." (Shelf Space) and It is DISH who would determine more of the agreement. It's the exact opposite of what happens with TV carriage. So in this case DISH (the grocery store) does not have to make agreements not to use future suppliers, if Coke does not like it, then the space goes to someone else.

(Keeping in mind I am only talking about legal sources, as Aereo thus far is)

I disagree.

Of course Dish doesn't have all the power. In this imperfect analogy, buyers that demand and want the missing Coke will start shopping at some other grocery store to make sure they keep on getting their Coke. Dish can put whatever else they want on the shelves (WFN, Voom, other locals, etc.), but those are not Coke, and someone that really wants Coke will still leave.

There's nothing new to add to the Dish -Disney situation since no one has any inside scoop into the negotiations. If we can't discuss tangential topics that could potentially impact the negotiations, then there would be no new comments in this thread until some news breaks about the negotiations.
