This says "moving" is against the law????

I thought fraud was for either financial OR personal gain. This would be for personal gain, given different scenarios.
Maybe it would be if you "moved" to an area where you would still get your in-market locals in addition to another market's locals, in one of the select few areas where Dish offers Significantly Viewed channels. Otherwise, you are giving up your own locals to be able to receive another market's locals. So, it is not really a gain, more like a side-grade.
 
People tried to claim the "no financial gain" thing when the RIAA came after all those kids who downloaded MP3's over peer-to-peer services. Didn't work.
Actually the RIAA didn't go after the downloaders, the RIAA went after the uploaders with a vengenance. Now many of those "uploaders" weren't aware that the peer-to-peer client they were using (Limewire as an example) would automatically act as a "seed" and participate in uploads as a "sharing" device unless they changed the default but the people that the RIAA to court were almost exclusively "uploaders" intentional or inadvertent.

I would like to see Dish add a screen where you could enter a ZIP code and the receiver would automatically switch to the locals from that DMA provided they're not on an out of area spot beam. I live directly between 2 DMA's and subscribe to one set of locals while receiving the other via antenna. The local cable company doesn't have such restrictive rules since they carry locals for both DMA's. Satellite should be able to play by those same rules.

People wouldn't do it if they didn't gain something, whatever that might be. Maybe they just enjoy watching the other DMA for some reason, that's still a gain for them.
 
I believe RV'ers can already do this through their mydish.com account-
I asked about this once. It only works through the mydish app, not the website. The app must geo-locate them through the GPS in the smartphone or some other method, since DIRT was clear in explaining that the locals would be based on the location of the equipment, not an address that you give.

It doesn’t limit what the personal gain would be. “Moving” for dropped channels, better coverage, more channels, sports team.. all of these are personal gain. The definition solely say financial OR personal gain... not what kind of personal gain.
 
There just seems like there would be a better way to do the DMA thing. My daughter's local channels that she wants are about 18 miles away. The city for her assigned DMA the local channels are around 55 miles away. She has nothing to do with her assigned DMA city. You would think the FCC should have a way to adjust things!

Where I can see it being an issue is if you are in a geographic location where you are officially in one sport team's market, but you want to access programming from another team. If I was on DirecTV, I could see myself trying this with a Connecticut market where I would be considered claimed by both Boston and NYC. I don't like the Yankees, Giants, or Jets; but I do enjoy the Mets, Knicks, Rangers, and Islanders. But, being on Dish, the only thing I would get out of this is watching local news from one market through Dish and my home market (Boston) via OTA. Better just stay with Boston.

It is possible to set the locals to a different location than where you are using one of the fake GPS apps available from the various app stores.
