Well, I've been firm in posting that the 2/17/09 digital cutover date is not changing, with no realistic chance of it being delayed again. After all, it used to be set by regulation, but now is set by law.

It seems the law has come into question. Due to a typo, the version passed by the House and Senate were not exactly the same, as required by the Constitution. So it's being challenged in the courts.

It is not expected that the date will change, even if it must come up for a re-vote. But no one is sure, because once you have a political football....

More info here.

I believe this complaint has been pressed on four separate occasions in the past, and always shot down, but there seems to be some reason they feel this attempt might make it. Or might become moot if the Democrats end run it by just passing appropriate legislation on the matter.

How it keeps getting refiled, I don't know. Different aspects of law over the same complaint?

But I sure like your link. Looks pretty iron clad to me. But then, I'm no lawyer!

It's not that they really think it will get overruled, but if it's being appealed come Feb 2009, stations could remain broadcasting in analog with possibly little repercussions.
