From Reuters-

An attorney for Dish Network LLC told a New York federal court on Thursday that ABC Inc has no more right to make consumers watch commercials than the New York Times has to make readers view the pullout adds in the Sunday paper.

In the 2nd U.S. Circuit Court of Appeals, ABC has appealed a New York district court in September that allowed Dish to keep selling its digital video-recording device, or DVR, The Hopper.

ABC, CBS Corp, NBC Universal Media LLC and the Fox Entertainment Group Inc have sued Dish in various New York and California courts for violating copyright by letting users make and view unauthorized copies of their programming.

Introduced in 2012, The Hopper allows Dish subscribers to automatically record prime-time shows from the four major networks and then skip commercials during those programs 24 hours later.

"Dish is not agnostic about the content being copied," ABC attorney Thomas Hentoff of Williams & Connolly said during oral arguments on Thursday. "They've chosen the most valuable programming from the major TV networks. Dish's service undermines nearly every source of revenue ABC can derive from its newest prime-time TV programming."

Dish attorney Joshua Rosenkranz of Orrick, Herrington & Sutcliffe, meanwhile, said the technology simply lets viewers "time-shift" their TV watching the way they have been able to do for decades with devices like videocassette recorders.

"Dish is not the one making these copies, the consumers are," he said. "ABC has no more right to make consumers watch commercials than the New York Times has to make readers view the pullout adds in the Sunday paper."

The lawsuit began in May 2012 when Dish, threatened with lawsuits by the major broadcasters, sought a judgment in the Manhattan district court allowing continued sales of The Hopper.

CBS, NBC and Fox filed lawsuits in California alleging copyright infringement, while ABC countersued Dish in the New York court. In September, U.S. District Judge Laura Swain denied ABC's request to stop Hopper sales, which led to the appeal.

The case is still in discovery and trial dates are being coordinated with the related Fox and NBC cases in California. The CBS case has since moved to U.S. District court in New York.

The case is In Re Autohop Litigation, U.S. 2nd Circuit Court of Appeals, No. 13-3573.

If they are still battling over the hopper and ptat,I don't see ABC/Disney/ESPN resolving their contractual dispute anytime soon.I thought that they had agreed to settle.Doesn't look that way now.

The way I read it, it's just attorneys blow-harding and re-hashing. I read nothing to indicate anything new in the case. Also, just a Reuters article, not an actual news report, IOW, don't believe everything you read.

Interesting it essentially comes down to if the consumer should be forced to watch commercials. Then if the consumer should be able to pay to avoid commercials.

The funny part is ABC and DISH will never get to court over this. I am hearing a rumor it will all go away (between DISH and ABC) once the DISH / DISNEY / ABC deal is finalized and signed.

Right now its all just a show because they have to continue on until the deal is signed.

One can only hope that this contract is finalized soon and then other networks come to the table and get settled soon after.

I'm surprised Walmart hasn't banned this guy from all of their stores. He has been on their CASE the past few months.

When walmart set a price...they weigh the container and the product...the product label only shows the weight of the product...I am sure if you brought your own plastic baggies to bring the product home you could get the cheaper price

Then they are stupid. Everyone knows that the price per ounce should be the price per ounce of actual product.

Well, the bag can't weigh that much, right? But by law food product packaging must display the actual net weight of the product, i.e., the contents of the container, so by any logic, if not law, a store's stated per-ounce cost should reflect that figure. But since there's not any law regulating shelf statements, a store can say whatever it wants without violating any rules. So I guess the answer is more consumer legislation. Or simply caveat emptor.

But a box can weigh more than an ounce..maybe 2...a can might weigh 5 ounces..a bag...not much

Well, according to the price per ounce on that first bag of coffee he mentions, that would mean the bag weighed over 6 ounces. That bag does NOT weigh 6 ounces. According to Google, an empty bag weighs half an ounce.

When you go to a Deli, the weight of the container is removed, so you only pay for the weight of the product .... at least where I shop.

That was part of the Ergen scheme, to sell the product as well as the service. And who didn't want the best box?

Maybe they went to the hopper because they were running out of 3-digit model #s- 1022 would have been kinda clunky. Folks would have tried to say "one-thousand and twenty two" instead of "ten-twenty-two".

Like some say "two thousand and twenty six".

That's not really unusual. Cable companies like to the provide the box too. The phone company provided the phones in until the government forced them to allow third-party phones.

Yes the Cowboys owner needs to fire the general manager (himself), co-owner, Chief Operating Officer (COO), Executive Vice President, Director of Player Personnel, and President of AT&T Stadium (his son) and then he should jump off of a cliff. Only then can they recover.

Jerry Jones and Jimmy Johnson had an argument about who was responsible for the dynasty building of the early 90's Cowboys.

The rest of us figured it out in about 3 years, Jerry has had over 30 years but still can't admit it. It's all he lives for, to show everyone he can put together a winner. I don't think he can. His kids only know what he taught them.

I was a devout Cowboy fan in the Landry era, grudgingly gave Jimmy his due, since then not so much, the Jones family took care of that...

WCWW/25 CW South Bend and WBKP/5 CW Marquette are now testing on the stream server. These are both already available on satellite.

Now live in the satellite guide:
663-2 PISTONS (663-1 is likely being reserved for an overflow feed of Detroit Sportsnet, if there's a 2027 MLB season)
675 THUNDER
693 CLIPPERS

Wait…..
So even though DAZN keeps touting 'only way to see games' if you are a subscriber to Choice (like my stepdad) if an agreement is reached he can see the Wolfies on 668?
I know the Wild are in dispute and a slate is on 668-1.

They're finally live in the app's API, doing a check

PISTONS is not available in Detroit (WMYD/20), it is available in the rest of Michigan including Marquette who also gets the games on their MyNet station WJMN/3, along with the Toledo DMA and the northern portions of the South Bend and Fort Wayne DMAs.

THUNDER is available in OKC and Tulsa, so I wonder if DTV is just going to keep the OTA feeds of KSBI/52 and KQCW/19 and direct viewers to 675 for the rest of the games.
On stream it's in Choice for Oklahoma (inlcuding the Oklahoma portions of the Amarillo, Sherman-Ada, Wichita Falls-Lawton and Joplin DMAs) and Western Arkansas and requires Sports Pack for Nebraska, Kansas and Western Missouri, I'm not sure if it's the same for satellite.

It appears we are not getting both home & away feeds out of market on League Pass for these teams either…

I've been watching the Spurs home feed on channel 676-1 (was part time San Antonio specific feed) out of market with NBALP for YEARS on satellite (through the multiple iterations of Fox Sports SW, Bally Sports SW, FanDuel Sports SW) Looks like that will not happen unless a deal is reached with DAZN. I do see the placeholder channel on 680 if it happens.

Center Ice does have the non-carried feeds, including the Hurricanes, Wild, Blues and Blue Jackets and spotbeam local only teams like the Panthers, Mammoth and Golden Knights. So it probably depends on the available part time bandwidth each night as things they are able to provide to in market viewers in the 600s, PPV Events in the 100s and commercial events in the 9000s get priority first, along with games where neither team has a remappable feed.

Just finished S2. Watching Gary Oldman as deshvilved, dejected MI-6 agent, Jackson Lamb, is one of the best things streaming right now. Already 2 more seasons in the works. HIGHLY recommended. And yes, Mick Jagger sings the theme.

Well, the season finale went balls to the wall. Non stop action and several twisted twists. Gary Oldman at his best. Very well written and executed. Tavener owes Jackson big time. Only "if" was Jack Lowden's (River) cliffhanger, especially admin-st the buzz that he is the next James Bond in waiting.

Planning to start the new season tonight. :)
