K26LV-D, branded as "KNPN", is an upcoming Fox-affiliated television station, licensed to St. Joseph, Missouri, that will serve parts of northwestern Missouri and northeastern Kansas. Scheduled to launch on June 2, 2012

The station isnt even on the air yet

Nah, probably just part of the carriage agreement. "Dish will upload feed with a banner advertising the addition of the new channel at least one week prior to channel launch."

And keep in mind, DISH probably must immediately carry the new St. Joe FOX, since they are currently carrying the (out-of-DMA) FOX from KC, WDAF. Since DISH is ONLY allowed to carry OOM affiliates in DMA's that are missing major networks, (as part of their agreement for being allowed to go back into DNS) they are wanting to play it totally safe!

no they don't. No law they HAVE to carry it. And the fact its LP makes it even more of the fact it doesnt qualify for must carry. But since its owned by the same people who own the only station in town (KQTV ABC 2) there is probably a direct feed already.

Here is another thing. If Dish or Directv launch a market and a station starts up after that, the provider can still keep the out of market station until an agreement is reached to carry the new station. Great example is the market down the road from me. Mankato, MN was a one station town for decades (KEYC CBS 12). Directv added KEYC in mid 06 and gave subs the other 3 stations from Minneapolis. KEYC launched Fox subchannel 7/1/07 yet DIrectv didnt start carrying it about 3 months ago. Those subs were able to keep Fox 9 from Minneapolis until KEYC-DT2 was added. When it was added (in glorious SD) Directv dropped KMSP Fox 9 from the cities. So if Dish (and DIrectv for that matter) didnt reach an agreement with the new Fox technically they could keep Fox KC on there until such.

Until Directv has an agreement and turns the signal on the D* subs will continue to get WDAF....so "and in a month DIRECTV" if that happens then the subs would lose WDAF

You said "must immediately carry" and they don't have to. They (the station) has to go through the same provision as all other channels to be carried. Since its a LP station it DOESNT qualify for must carry. But it sounds like both will carry it. Dish has their balls grabbed a little harder from the FCC when it comes to stations not "local" so thats why they probably signed on right away. Directv doesn't have that issue. Until the station is uplinked and turned on by the provider the out of market Fox from KC can stay on there. I gave a perfect example above. The Fox affiliate in Mankato was around for 4+ years but Directv just started carrying it. Until they did, they were allowed to carry Fox9 from Minneapolis which is an out of market station due to I guess a "grandfathered" ruling.
