I forgot to completely address this:What the FCC defines and what a contract defines are two different things.

DirecTV and Dish Network are the first to test the FCC access requirement by "serving notice" to Comcast that they want access to CSN Philly. I believe Verizon won't be far behind with respect to MSG HD. The FCC's access requirement does address that simply providing the SD channel only does not fulfill this requirement, but until someone can:

1) challenge according to the process,
2) win the challenge at the FCC, and
3) withstand any legal challenge overturning the FCC's rulemaking regarding this process...

the channels will not be on systems.

I agree but I never alluded to any contract defining channels as being equivalent. My point was simply that a reasonable inference from a claim made by one of the parties in this dispute (i.e. Disney) is that SD and HD channels are distinct and different. Whether such an inference would have any impact outside of this particular contract dispute is, as you say, highly doubtful. I was merely observing that this is the very same question that is at the heart of the "FCC loophole hearings".

Acutally, they are somewhat uncommon.

You have an ongoing contract for services, for which you are being paid. Now the contract is about to lapse, and the paying party wants to change so many terms of the existing contract that you'll now receive less money and you have to provide more services.

Meanwhile, your business partners expect your revenue to grow.

And the "gotcha" here is that if you provide those "more services" for "less money", the Most Favored Nation status can kick in and then drag down your revenues from other payers.

That's why a "do over" is darn near impossible. That is why the horse should have never been let out of the barn in the first place. And if Dish Network expects the Disney subsidiaries to simply give them the HD channels for free (putting the horse back into the barn), I have some satellites I'd like to sell them. They aren't my satellites... :)

If Dish doesn't bring the channels back they would technically be in breech of anyone that contractually joined under the "Free HD for Life" promo.

Personally, I have Dish Absolute & now I have no family friendly programming... The most insulting thing is that no notice was given. To me this is just a completely unacceptable business practice.

Personally, I have Dish Absolute & now I have no family friendly programming... The most insulting thing is that no notice was given. To me this is just a completely unacceptable business practice.

They aren't in breech of contract. All of their contracts say they have the right to add, remove or change the channel line up at anytime. HD for life is just an add on.

I disagree, When you the customer signs said contract your agreeing on the terms in which they sold you which may be a certain channel or channels. A contract is between two parties not just one ask any lawyer. I signed up with Dish for certain channels and service and if I'm not getting it then they are not upholding their end of the deal regardless.

I've been without the channels as with the rest for..what two weeks now? So yeah I'm going to get on the chat most likely in the next few days and raise hell to the point I get some sort of compensation. Would I watch the channels if they came back? Prob not cause I didn't before but that's not the point. I'm looking forward to them coming back with a legal end to this nonsense between them all and also hoping to get ESPNU HD also! :up

When you agreed to receive Dish programming, you also agreed that they could change, drop, add programming at their discretion.
Now, you might get a credit ($2-$5) off your bill, but they didn't breech anything.

Let us know if you get anything out of them. You might get a couple PPV coupons but as far as breech of contract you must not have read the part about they have the right to change up things. :cool:

If Dish's SD was watchable, I'd agree with you. But a lot of Dish's SD looks like garbage, on the size of screen that most people have these days.

While I prefer HD, I certainly don't agree that Dish's SD looks all that crappy. Well on some channels it does (Chiller comes to mind). But it is better than any SD I was getting on D* in a previous life. :)

I don't have children at home, but when I'm visiting those that do, the kids seem to enjoy the TV regardless and don't even notice HD or SD as long as it moves, is colorful, has good sound and keeps their attention.

I'm a fairly new subscriber to Dish and admittedly don't watch much in SD...however the channels that I have watched look decidedly better in SD than with Time Warner Cable. In fact, most of the SD is really darn good. Very clear, vivid and almost "semi-HD-like" for lack of a better term. Perhaps it's just that SD on TWC was so bad. But anyway, I don't cringe anymore like I used to do when I want to watch something that is not in HD. Admittedly, I still prefer the HD! ;)

By the way, speaking from the perspective of watching this on a 55" Samsung LED-LCD (so definitely not a small screen).
