No Injunction in VOOM/DISH Litigation

(New York) VOOM, the high-def content entity that's part of Cablevision's Rainbow programming unit, lost its bid for a preliminary injunction that would've required DISH Network to keep the service's HD channels on a more widely-distributed tier.
According to the case before the New York Supreme Court, DISH told VOOM that it would re-tier the HD channels on Feb. 1, citing a lack of commitments by the programmer to spend money on developing the channels. After discussions between the sides, the satellite TV company later informed VOOM that it would terminate the affiliation agreement between the companies, which led VOOM to file the court request for a preliminary injunction preventing DISH from removing the networks, stated legal documents.
The court issued a decision this week that denied the preliminary injunction. In its decision, the court suggested that VOOM "failed to demonstrate a likelihood of success on the merits" in the case.
On Tuesday, the VOOM channels were still listed on the DISH Web site, in the "DishHD Ultimate" package. The "DishHD Essential" offering is the more widely distributed service.
And the litigation remains before the New York court.
