Dish/Echostar tried a shell game to control spectrum and not build on it. Now the chickens have come home to roost, affecting all new satellite applications until their construct/launch backlog is reduced. Looks like they will be losing some bond money also.

Echostar 16 has been announced as under construction.

But, they have not applied for a license and it seems to fall under this order.
 
Who cares, dish has so much bandwidth they are wasting right now on QPSK transponders and SD MPEG2 duplicates, they could fund an entire swap out of all the old MPEG2 recievers to 8PSK/MPEG4 for the cost of the build out of one of the potential satellite spots they have lost.

Looks like Echo is attempting to "warehouse" orbital slots and spectrum....That would be a no-no.

Five permitted but unbuilt BSS satellites and one FSS.

This is something like 1.8 billion dollars.

And, FCC says no new satellite licenses until they get the "backlog" down to two unbuilt.

The lawyers are going to make some money on this one.
 
Another thing Dish Network has done to push people and going too far. Looks like he lost this poker game.
The game is just starting. Charlie opened, FCC has raised the stakes, now Charlie has to call, fold or raise again. Or maybe kick over the table. :D
