HD Tivo / Lease Question

So if I were to buy a brand new, never used HD Tivo (HR10-250) from a reputable seller on Ebay, can I both activate it and own it now that Directv is lease only?

from what ive heard if this is not a lease from this person/shop you can activate and not be on their lease terms but if it is private you can activate and not be on the lease terms. but who knows ! the rules seem to change daily with directv

My understanding is that if you are buying from a private seller then you own it. But if there is any problem with the equipment they will not cover it and you do not qualify for any special programs through them. I just purchased a Hughes TIVO unit on eBay and pulled my old card from an old receiver since the lease program started. They allowed me to change it without a problem or fees and never once mentioned about starting a new contract or lease. Now if you have to get a new card and do not have your own card the deal may be different.
