Dish is also missing a few Showtime channels too, but in all honesty if you have an Internet connection all of the contents of Cinemax can be Viewed On Demand.

For the same reason DTV doesn't carry pac12 or the Blaze.

The same reason why DirecTV does NOT carry 1 of the Cinemax channels, OuterMax...

Agree with this. It has made the actual channels a lot less important since you can just go to the ondemand section and watch anything that is currently available on the channels.
