HDNet Settles Suit With DirecTV
Cuban’s Service Remains On Satellite Provider’s Primary HD Platform

In what Mark Cuban described as a “win-win,” HDNet has settled its lawsuit against DirecTV, which stemmed from the satellite provider’s plans to move the network to a new tier of “HD-only” channels, officials said Thursday.
The settlement keeps HDNet on DirecTV’s main HDTV platform, while HDNet Movies will migrate to the satellite distributor’s new $4.99 HD Extra Pack.
HDNet and DirecTV had been scheduled to appear before the 101st Judicial District Court in Dallas tomorrow, Friday, for a hearing. HDNet was seeking a temporary injunction to bar DirecTV from shifting it and sister service HDNet Movies out of the satellite company’s most widely distributed HDTV offering to the Extra Pack, which is scheduled to launch later this month.
But that hearing was cancelled Thursday, following the settlement, which appears to be a compromise of sorts.
In an e-mail Thursday, HDNet co-founder and owner Cuban said, “HDNet will be fully distributed and HDNet Movies will be available on the Extra Pack Tier. It's a win-win for all involved.”
Cuban, declining to offer more details, added, “It actually turned into a very amicable process and we were able to work things out rather quickly.”
DirecTV spokesman Robert Mercer confirmed that the case had been settled, but declined to discuss the terms.
Back on Nov. 12, the court in Texas had issued a temporary restraining order that prevented DirecTV from moving Cuban’s two networks to the new tier, the DirecTV HD Extra Pack, that will only include six channels that don’t have standard-definition counterparts. That premium HDTV tier will cost subscribers $4.99 a month, on top of the $9.99 HD access fee that DirecTV charges for its newly expanded lineup of roughly 80 national HD networks.
DirecTV was slated to move Cuban’s two networks to the HD Extra Pack was Dec. 15.
HDNet lawyers, in a filing with the Federal Communications Commission, accused DirecTV of trying to “kill off” the network by moving it onto the HD Extra Pack, which is not likely to have as much penetration as HD Access.
In its suit, HDNet claimed that DirecTV would be violating it an affiliation contract if it shifted the network from the HD Access level.
In response, DirecTV had denied HDNet’s allegations, claiming it had no contractual obligations to offer HDNet in any basic programming package. DirecTV also argued that its $9.99 HD Access offering was not a program package or tier, but rather an equipment or technology fee.

So now that HDNet is going to remain on its present tier, what nets will be on this "Extra" tier, besides HDNet movies? I presume they will "fall off" the programming
on Dec.15th unless you sub to the new tier?
 
I had a feeling there was going to be an increase somehow, someway. All the additional HD's, programming, Sats, etc. Maybe there is enough competition to keep the additional price increases to a minimum for us subs. Hold on folks it isn't over yet.

Smithsonian HD
HDNet Movies (was going to be both)
Universal HD
 
Honestly I'd rather have HDNet Movies as opposed to HDNet. I can't remember the last thing I saw on that that really interested me, aside from some random MMA stuff (which will prove useless once Spike goes to full HD.) At least the movie station will show movies. I recently saw the original "Psycho" on that for the first time. If you're going to see a movie, may as well see it in HD. ;p

$4.99. When you consider that you basically get 3 movie channels (HDNet Movies, Universal, and MGM) for less than half the price of a typical premium movie channel subscription it's a good value.

I am sorry, Universal HD sometimes has the X games on (IN HD) which I really like, but other than that, MGM/HDNET Movies, don't have nearly as many *Hit* movies like HBO/Cinemax/Starz/Showtime have.
I have the premier package(All premium movie channels and sports package) with NFL ST+SP, I pretty much have all the channels but I dubt I want to add another 5$ a month for some of the channels I barely ever watch, or even those channels don't have as big hit movies as my other movie channels do.
Now I like some of the shows on HD Net and Universal.
MGM and HDNet lack the big hit movies that attract people.
I personally think the Premier subscribers should have this channel added to thier package for no additional cost, I know now I am sounding greedy, but for the amont of money we pay monthly, that be a little incentive towards the customers, especially making them happy.
And yes I do know the extra pack name is HD Extra package name.
 
Smithsonian does have some impressive HD. From what I have seen, since these channels are only HD, they broadcast pretty darn good PQ.

Well, Discovery HD Theater does NOT have an SD equivalent & it gets to stay in... ;) ;) (it is NOT the same as SD Discovery Ch at all, since it combines shows from multiple channels, as well as since there IS now a dedicated Discovery Ch HD)
