OFFICIAL DISH / FOX ORDEAL DISCUSSION THREAD

I just got off the phone with Dish Network. I stated my case, removal of MSG. Keep in mind I have the Everything Package, Platinum HD, and Multisports Pack, with 6 receivers (5 DUO DVR's) Total bill per month of $188+. All they could offer was 6 PPV coupons.

So I dropped to Top 250 with HBO, Dish then offered Free Starz for 3 Months, and Free Platinum HD. I told them I had a DirecTV install Date for Friday (which I do with a local retailer), if MSG isn't back on Friday then I will likely cancel completely.

Buffalo Sabres games are the reason I'm with Dish in the first place, back in 1997, Time Warner would not provide access to the Buffalo Sabres games, seems Ironic the Buffalo Sabres games are the reason I'm probably churning to DirecTV, although I'd like to stay because of the Better HD channels selection.

Dish can keep my 150 + monthly revenue, but they have to step up to the plate.

I don't recall being notified at any time of these changes.
Dish will (can) claim that Fox pulled the channels w/o notice (or very little notice).

In the end, if someone wants to take Dish to court over the contract, more power to 'em ! Let us know the outcome too !
 
Hard to believe so many members would jump ship on Dish for some channel outage
issues that will be solved shortly. If anyone cannot support Dish for a few days, then perhaps they should leave....

I'm with you on that most of the time, but this time, channel outages in places like where I live (Buffalo) that take away something alot of people are fans of (hockey), is a really big deal.

Losing hockey on TV in a market like say Phoenix or Tampa may not be a big deal to the masses but in a place like Buffalo, it's huge.

I agree it should get resolved......but then again, it may not. And that scares alot of people who have had something taken away from them that they really love to watch.
 
This is generally correct, but the law does impose reasonable limits and a contractual term cannot be "unconscionable." If they dropped half of the channels but said you would still have to pay the full price, you would have a case. If you are paying $10 a month for HBO and they drop HBO, I don't think they could force you to keep paying the $10 a month.
The logic I use with my wife when she says "we should get a refund or credit..." is this:

200 channels / $29.99 / 30 days

We're paying $0.005 per channel per day. All channels have to be treated at equal cost since we don't know anything otherwise. If multiple channels are involved, do the math. If someone gets a $5 "credit", let alone $5 x multiple months, they've made out !!
 
Number 9-23 are ancient dead channels partially owned by Dish that were essentially demo channels for HD. Now that every TV channel is in HD, we do not need special HD channels so we can say "Ooh it is HD !". We do not see Dish carrying a special "Color TV Channel" from 1964 either.

Your post is unresearched at best , since incase you forgot this was a Stand alone Satellite company. And Dish Network decided to use its services and then F'ed them over when it was time to pay the Bill, and Walked off with their satellite to boot.

5 was a fake channel created by Dish to show how easily one could create a Weather Channel. The idea that you are calling it a "dropped" channel is hilarious !

If this were Buffalo's cable company, I'm sure they'd put a LOT more weight or value on resolving this, but Dish is a NATIONAL provider. People in the were real interested in Dish (or Directv or the cablecos) carrying the Big 10 Network, but did the majority of people in FL or TX or CA care ?
 
This is just my off the cuff reaction and not any sort of full blown legal analysis (and depending on individual state laws, things may turn out different if one were to go to court), so this is not legal advice.

billdz, for some reason, I can't quote you directly or cut and paste your response on my iPad. However, here's my take on the unconsciounability argument you threw out there:

The basic premise in the US is that of freedom of contract, whereby with few exceptions (illegality, incapacity, etc.) individuals are presumed to be free to enter into binding legal contracts with other individuals. Unconscionable contracts and contracts of adhesion (think incredibly one-sided, take it or knave it, boilerplate form contracts) aren't excuses for getting out of most contracts. They are mostly used when one side is providing the other with a basic need and is using their position of power as related to providing that basic necessity to fierce the other person into unfair contract terms. You won't find many courts that will deem TV as a basic need (especially since in most places there is at least one alternative provider and the consumer chose Dish and agreed to the contract terms).

How were we notified of this? I don't recall get an e-mail or notice in the mail. I don't think the guide data counts.

The contract doesn't specify how they will notify you. As such, it can be argued that any notice is sufficient. Whether you think it counts or not, the notice provided in the guide and Charlie's explanatory video are likely enough to meet the contract terms.

No, another portion of the contract unrelated to programming changes states that you are responsible for cancellation fees if you choose to cancel before your commitment period is up. It doesn't need to be explicitly stated here because the other portion of the contract includes it.

This is my big problem with the disputes. The price increases of the past year have been unprecedented (at least in my household), so this trying to keep prices down argument just doesn't sit well with me.

This thread has gone down the tubes. Totally. What's with this old list of VOOM channels?:confused: History, that's what I say. Nobody offers them, except for a few on Bell up in Canada. Move on. Now if your local RSN is dropped... I feel for those and hope DISH gets them back --soon--. :rolleyes: I would drop DISH if your local FSN/regional was dropped for a couple of weeks. Fine. I would also drop them if the NHL-CI or NBA packages are radically altered.

I'm very concerned, I sub to NHL-CI and will not be happy if my games are scalped by this childish disagreement between FOX and DISH. Bargain both of you please. If DISH loses the local FOX-TV next month in Chicago, LA, NY, etc, this will be the biggest f-up to date, for both sides.

I'm enjoying NatGeo-HD/NatGeo Wild HD on Frontier FiOS. [But I don't know if it's worth switching to D*, etc. for though...]

Its part of a History of dropped channels, Not my fault.
Its an on going known trend with Dish Network. Got nothing to do with whether I liked these channels or not.

The point is Dish Network is Bad at dropping channels when they want and when ever they want. Thats the Point!!!

I never said anything about me liking the channels they dropped. Far from the point.

No channel is Safe in Dish Networks line up. History Shows that 15+ channel drops in a single day are not uncommon.

So yea lets give Murdoch what he wants just because he wants it. Good strategy, so whatever E* agrees to pay gets pushed onto you.
In the short term that may seem like a good idea. Try to think of the long term effect on the whole industry, Charlie caves and pays Murdoch, in doing so sets a precedent when Dtv and cable contracts come up, they go to the table and get 'Look what we got from E*'.
Anyone who thinks Fox has no blame in this has their head in the sand. Corporate greed, pure and simple.

Sorry but at this point Cable is better then Dish, Atleast they have all the channels your paying for, not channels your still paying for but don't have.:)
