Google demands that "Dish" Android remotes have voice command available. So Dish threw out the 40 remote as useful on the +s for this reason. Of course the 40 remote can be duplicated on a Harmony remote. I can use my harmony remote just fine on my TCL Google TV as well.

I never opted out of it that I recall, and it wasn't on by default for me.
