Patent Office upholds Tivo's "time warp" patent, EchoStar not so happy - Engadget

Like I said, Mike, no one ever saw the official ruling rejecting the hardware claims. Echostar issues a press release about it, and it is taken as gospel. Even TiVo issued a press release about those rejected claims. And everyone here believes the hardware claims were rejected, without seeing a copy of the ruling.

Now the reverse has happened, with both TiVo and Echostar issuing releases about the affirmation of all claims in the Time Warp patent. This time, no one wants to believe it.

The apologists are really hard to believe, thats for sure. :) Whether they like it or not, IF E* is not in process of settling this whole matter, TiVo would be foolish not to go to the appeals court and based on the PTO ruling not get the temporary order removed. Yes, they are accruing penalties for infringement on a daily basis, but until they actually force E* to turn off their DVRs (or face the DOJ's wrath for ignoring a court order), they will just be dragging this whole thing out (or allowing E* to drag it out.)

I seriously look for E* to pay off TiVo soon and license the patents, to take any other course seems irresponsible and depending on the $ amounts, could be interesting in a proxy fight at the next E* shareholder's meetings. (Stranger things have happened!)

The capitalism apologists are really hard to believe, that's for sure :) Whether they like it or not, patents have become a tool to stifle innovation rather than stimulate it. The fact that people continue to develop free software of high quality (i.e. Linux and everything that runs on it) proves that people who want a better world will work to achieve it without thought of reward, so the public would be foolish not to demand that the concept of intellectual property take its rightful place on the garbage dump of history along with other state-enforced religious beliefs.

:) Thanks for the great laugh, chuckie!

You are now nominated for the "most ridiculous argument of the year award."

If you ever bother to check out ANY facts whatsoever, you may notice that Linux is a copyrighted material and has reserved rights as well. Same for most of the decent apps that run on that base product.

If you're referring to the General Public License that prevents Linux from being converted into a proprietary product, that's a good thing for the consumer. You must think it's a bad thing because you stand for greedy businesses. The real ridiculous argument is the one that says that a business, a fictional entity, should have the same rights as a human being.

Uh, all of the Constitution and its amendments apply to both people and businesses.

Now Greg, don't confuse him with facts. :) There are some that are making such irrational and baseless arguments about this topic that its simply hilarious.

Of people don't like the patent laws, they ought to get off their a$$es and get the law changed, but until it is, STEALING patented technology is NOT legal, no matter how much of a chuckie apologist you are. If the patent laws are changed to allow infringement (nice word for THEFT) at will, look for only the extremely foolish to spend money on research and development, as without being able to own the technology and use or license it for a predetermined time, there will be no incentive whatsoever. None, nada, zilch.
M

Nope, take a look at the software, there are copyrights on Linux and most of the products I have seen for it. The GPL is a novel idea and is serving its purpose, but it is NOT the same thing as a copyright. Check out wiki or somewhere to find out the differences, as you seem to be confusing patents, copyrights, GPL, etc.

You must think it's a bad thing because you stand for greedy businesses.

Say what? And you know that because? lol, you have no idea what you are saying, just ranting because you think THEFT is ok, huh? Do YOU steal often or do you just think its ok for E* to when they find it convenient? Exactly when do you support theft? Do you support bank robbery as well? :D

It looks, by your blind support of E* in this matter that YOU are the one who supports greedy business, does it not?

The real ridiculous argument is the one that says that a business, a fictional entity, should have the same rights as a human being.

Aha, you are a Marxist? Or do you just pick and choose which laws you will obey? Is it OK for a corporation to steal, but not people? Vice-versa?
K
GPL is a license of software that has copyright protection. The author(s) grant free use of the software and source code with the requirement derivate works be made available to the public. The lawsuits against companies violating GPL are claims of violation of the authors copyrights.

A good example is mysql, this software is available from the author in both GPL and commercial licenses. If you don't want to be subject the GPL license you can pay for a traditional commercial license.

I'm surprised Walmart hasn't banned this guy from all of their stores. He has been on their CASE the past few months.

When walmart set a price...they weigh the container and the product...the product label only shows the weight of the product...I am sure if you brought your own plastic baggies to bring the product home you could get the cheaper price

Then they are stupid. Everyone knows that the price per ounce should be the price per ounce of actual product.

Well, the bag can't weigh that much, right? But by law food product packaging must display the actual net weight of the product, i.e., the contents of the container, so by any logic, if not law, a store's stated per-ounce cost should reflect that figure. But since there's not any law regulating shelf statements, a store can say whatever it wants without violating any rules. So I guess the answer is more consumer legislation. Or simply caveat emptor.

But a box can weigh more than an ounce..maybe 2...a can might weigh 5 ounces..a bag...not much

.a bag...not much
Well, according to the price per ounce on that first bag of coffee he mentions, that would mean the bag weighed over 6 ounces. That bag does NOT weigh 6 ounces. According to Google, an empty bag weighs half an ounce.
Jimbo

When you go to a Deli, the weight of the container is removed, so you only pay for the weight of the product .... at least where I shop.

I would think that the Vendor/Maker of the product would have a say in it, showing the Correct weight ...
You would think it would be in the contract.

I do look at the ounces of items, but unless its way off, I don't check the math, may have to start now.

Remember when you use to get a 13.5 oz bag of Chips .... Thats a PARTY Size now.

That was part of the Ergen scheme, to sell the product as well as the service. And who didn't want the best box?

Maybe they went to the hopper because they were running out of 3-digit model #s- 1022 would have been kinda clunky. Folks would have tried to say "one-thousand and twenty two" instead of "ten-twenty-two".

Like some say "two thousand and twenty six".

That's not really unusual. Cable companies like to the provide the box too. The phone company provided the phones in until the government forced them to allow third-party phones.

Be nice to see a Cowboy headline like that.
Yes the Cowboys owner needs to fire the general manager (himself), co-owner, Chief Operating Officer (COO), Executive Vice President, Director of Player Personnel, and President of AT&T Stadium (his son) and then he should jump off of a cliff. Only then can they recover.
rvvaquero
Jerry Jones and Jimmy Johnson had an argument about who was responsible for the dynasty building of the early 90's Cowboys.

The rest of us figured it out in about 3 years, Jerry has had over 30 years but still can't admit it. It's all he lives for, to show everyone he can put together a winner. I don't think he can. His kids only know what he taught them.
dfergie
I was a devout Cowboy fan in the Landry era, grudgingly gave Jimmy his due, since then not so much, the Jones family took care of that...

WCWW/25 CW South Bend and WBKP/5 CW Marquette are now testing on the stream server. These are both already available on satellite.

Now live in the satellite guide:
663-2 PISTONS (663-1 is likely being reserved for an overflow feed of Detroit Sportsnet, if there's a 2027 MLB season)
675 THUNDER
693 CLIPPERS

Wait…..
So even though DAZN keeps touting 'only way to see games' if you are a subscriber to Choice (like my stepdad) if an agreement is reached he can see the Wolfies on 668?
I know the Wild are in dispute and a slate is on 668-1.

They're finally live in the app's API, doing a check

PISTONS is not available in Detroit (WMYD/20), it is available in the rest of Michigan including Marquette who also gets the games on their MyNet station WJMN/3, along with the Toledo DMA and the northern portions of the South Bend and Fort Wayne DMAs.

THUNDER is available in OKC and Tulsa, so I wonder if DTV is just going to keep the OTA feeds of KSBI/52 and KQCW/19 and direct viewers to 675 for the rest of the games.
On stream it's in Choice for Oklahoma (inlcuding the Oklahoma portions of the Amarillo, Sherman-Ada, Wichita Falls-Lawton and Joplin DMAs) and Western Arkansas and requires Sports Pack for Nebraska, Kansas and Western Missouri, I'm not sure if it's the same for satellite.

It appears we are not getting both home & away feeds out of market on League Pass for these teams either…

I've been watching the Spurs home feed on channel 676-1 (was part time San Antonio specific feed) out of market with NBALP for YEARS on satellite (through the multiple iterations of Fox Sports SW, Bally Sports SW, FanDuel Sports SW) Looks like that will not happen unless a deal is reached with DAZN. I do see the placeholder channel on 680 if it happens.

Center Ice does have the non-carried feeds, including the Hurricanes, Wild, Blues and Blue Jackets and spotbeam local only teams like the Panthers, Mammoth and Golden Knights. So it probably depends on the available part time bandwidth each night as things they are able to provide to in market viewers in the 600s, PPV Events in the 100s and commercial events in the 9000s get priority first, along with games where neither team has a remappable feed.

Just finished S2. Watching Gary Oldman as deshvilved, dejected MI-6 agent, Jackson Lamb, is one of the best things streaming right now. Already 2 more seasons in the works. HIGHLY recommended. And yes, Mick Jagger sings the theme.

Well, the season finale went balls to the wall. Non stop action and several twisted twists. Gary Oldman at his best. Very well written and executed. Tavener owes Jackson big time. Only "if" was Jack Lowden's (River) cliffhanger, especially admin-st the buzz that he is the next James Bond in waiting.

Planning to start the new season tonight. :)
