IN THE UNITED STATES DISTRICT COURT OF THE EASTERN DISTRICT OF TEXAS MARSHALL DIVISION
TIVO INC., a Delaware Corporation

V.

ECHOSTAR COMMUNICATIONS CORPORATION, a Nevada Corporation, ET AL.

ORDER

Pursuant to the Court's April 23, 2008 Order, Plaintiff TiVo Inc. submitted topics for discussion at the status conference on May 30, 2008. One of the topics discussed at the status conference was enforcement of the Court's Permanent Injunction. Specifically, TiVo requests a hearing at the earliest possible date to determine the following: (1) whether Defendant EchoStar Communications Corporation should be held in contempt for its failure to disable the DVR functionality in the Infringing Products and for its placement of new infringing DVRs; and (2) with respect to EchoStar's modified software,1 whether TiVo should be allowed permission to serve limited discovery to obtain additional technical information before bringing a motion for an order to show cause why EchoStar is not in contempt for the continuing use of the Infringing Products, changed only by downloading modified software.

The Court has set for hearing September 4, 2008 the first issue of whether EchoStar has disabled the DVR functionality with respect to the Infringing Products as required by the Court's Permanent Injunction.2 The second issue outlined above, namely TiVo's request to take limited discovery regarding EchoStar's allegedly new software, is denied at this time. In the interest of judicial economy, the Court will determine first whether EchoStar should be held in contempt for its failure to disable the DVR functionality in the Infringing Products and for its placement of new infringing DVRs as urged by TiVo or whether, as urged by EchoStar, the language of the Court's
Permanent Injunction allows EchoStar to comply with the spirit of the injunction by changing the software so that the products no longer infringe. TiVo may renew its request to serve limited discovery regarding EchoStar's modified software after the Court's decision on the first issue.

IT IS SO ORDERED.

1. EchoStar asserts it has complied with the Court's Permanent Injunction by replacing its1
existing infringing software with redesigned software based on a novel approach.
2. At the September 4 hearing, the Court will also consider the damages that TiVo incurred2
during the period that the injunction was stayed.

How about this....Charlie buys Tivo, throws the existing case so EchoTivoStar wins, and then goes after Motorola, Direct, etc and makes another Billion!

If it weren't for these patents Tivo would have been dead already..... Buy them out and end the threat of that Sword of Damocles hanging over E*'s head.

Not to mention that an E* box with Tivo AND Slingbox features would be a world beater. D* still has sports, but E* can reposition themselves as the enthusiast's service (assuming that brand of enthusiast could care less about out of market sports)

Nope, DirecTV bought a license when this all started. They are clear. And Motorola had Tivo write the CableBox Tivo firmware, so I think they are ok also since Tivo would not sue someone they are working with to modify their boxes to be tivos.

TiVo has not made any deals with Motorola. TiVo wrote the software for the Motorola boxes on their own.

Not true.

Motorola authorized the software, in 2005. Modifying someone's firmware in a intellectual property box is illegal. The definitely got permission in 2005 to do this

Bad comparison. Referencing the Sword of Damocles infers that E* did nothing wrong other than produce a successful product. Chuck could have handled his business better here and prepared for the eventual attack by Tivo. Desperate companies these days survive by lawsuit. He knew it, he didn't care and the ongoing litigation is a result of poor preparation.

Infringing or not, if he had repaired the issue prior to it being brought to the court's attention (he obviously knew something about it, he had software updates pushed within days of the court order,) this entire item could have been avoided; much like distant locals.

It's not what Chuck does or how he does it. It's his redneck personality where he doesn't proactively address potential threats until they become actual ones. It saves a little bit of money, but (for the rednecks out there) just because a snake doesn't bite you the first time you put your hand in the jar, doesn't mean it won't bite you.

Nope. Not a single mention of a deal between Motorola and TiVo.
F
Nope. Not a single mention of a deal between Motorola and TiVo.

This is an article describing the Motorola-Comcast-Tivo indicating that Comcast and Tivo have a deal to do software for Comcast's Motorola boxes.

Whether or not Motorola had any say in this is open to speculation. My guess is that Comcast as the marketer of the Motorola Box had permission to do this, even if Tivo did not. And that they had the authority to transfer that right to Tivo. The effect would be the same: Tivo could legally develop software for the Motorola boxes developed for Comcast.

IN the real world, people hire developers for all kinds of things. I am sure tivo would not have done this if it did not think it had legal standing to do it. And I have not heard Motorola squawk about it.

When I write things for other companies, they have the right to change it, typically. And they could hire someone else to change it. It's in most contracts.

Could Tivo do that for other cable companies? Don't know.

Terrible tragedy. You would think that they would have safe guards in place that would prevent something like this from happening. I guess if you are going to ride in a passenger train it might be best to get a car near the rear.

They will have to look at the switching sections to determine WHY 2 trains were on the same track ... at the same time.

Sometimes a thread gets so many posts in it that is can cause issues for the server so that why today we introduce The Song Name Game Part 3!

So let the game continue!

The last song was added by Bobby who posted...

One Meat Ball - Andrews Sisters

CONTINUE ON AND HAVE FUN! WELCOME HOME TO SATELLITEGUYS.US!

Here are the original rules for the game as posted by WebbyDude back in 2006. http://www.satelliteguys.us/threads/68645-Song-Name-Game

Just name a song title and the band who performed it. The next person does the same thing, but needs to list a song title or band name which includes a word from the previous entry. Pick songs from any genre.

Example:

Long Live Rock and Roll -- Rainbow

Rainbow in the Dark -- Dio

Another example:

Ride the Lightning -- Metallica

Lightning Strikes -- Ozzy Osbourne

Get it?

An additional note: we all know that song titles, sometimes, use profane words. Because this is a family friendly website it is advised that you clean up that title up a bit. This is accomplished by using something like sh!t instead of the real word. Thanks....

That goes for a lot of people. I've been advertising on radio for more than a decade now and am very familiar with this subject. While it is still a valuable tool, it has far less impact than it did just a few years ago. The best reaction I get is from a local Country music station....they play a mix of older and newer music and have a very big footprint.

No, just regular FM stations. One is the country station I mentioned and the other is a Talk Radio station which used to get fantastic results but honestly, since the death of Rush Limbaugh, talk radio just doesn't do as well. There were two guys who had an early morning show which was hugely popular here in the southeast but one of them retired a couple years ago and the show just doesn't garner the same numbers as it used to.

Haven't listened AM or FM in years

You knew the answer before you asked it.

I can't recall having encountered a local ad on Sirius, and I don't imagine it is any different on XM.

For those dazn nba channels are they sat only or sat & streaming
K
Both, and they just made it official with a multiyear deal that also includes TV Everywhere authentication for the DAZN app, and commercial distribution.

DIRECTV, the premier provider of digital television entertainment in the United States, and DAZN, the world's leading sports entertainment platform, today announced a new multi-year distribution agreement for local telecasts of Cleveland Cavaliers, Indiana Pacers, Memphis Grizzlies, Minnesota Timberwolves, and San Antonio Spurs games for DIRECTV streaming, satellite, and U-verse customers in each team's respective NBA-designated home territories.

These DAZN telecasts will be available to DIRECTV customers who subscribe to the Choice or higher packages and to U-verse TV customers who subscribe to the U200 or higher package. Each of DAZN's team services provides live pregame, postgame, and in-game coverage for the respective team.

In the coming weeks, customers who receive access to these teams via DIRECTV will also be able to login to the DAZN platform at no additional cost using their DIRECTV login credentials.

This agreement also provides distribution rights to each of the five NBA teams to all of DIRECTV FOR BUSINESS' thousands of sports bars, restaurants, fitness clubs, and other commercial venues located within each team's respective region.

I know HipKat said that they were working on conversions but we got the official news yesterday right from Dish that starting next month all DMA's will be on the western arc, and all customers will be assigned to that. That's gonna mean a lot of customers around here aren't gonna get Dish unless there are exceptions. Too many mountains and trees.

I watch mostly SD channels (H&I, Start and ION, etc.). There are plenty of advertisers, this time of the year it is mostly Medicare Advantage plans, auto extended warranties and the occasional walk-in-tub. They know who is watching.
