ENGLEWOOD, Colo. – June 8, 2010 – DISH Network L.L.C., a subsidiary of DISH Network Corporation (NASDAQ: DISH), and EchoStar Technologies L.L.C., a subsidiary of EchoStar Corporation (NASDAQ: SATS), issued the following statement regarding recent developments in TiVo vs. EchoStar Communications Corporation:

"We are pleased the Patent and Trademark Office issued a Final Office Action maintaining its rejection of the software claims of TiVo's patent. These software claims are the same claims that EchoStar was found to have infringed in the contempt ruling now pending for en banc review by the Federal Circuit. In the Final Office Action, three examiners of the PTO considered TiVo's response and, in a detailed 32-page decision, finally concluded that the software claims were unpatentable in view of two prior art references."

Who calls the shot as to whether the ATT/MS case is moved out of Folsom's court? If its the Federal Circuit hearing the Tivo vs. Echostar case, then that should be pretty telling as to its views of Folsom's previous actions if the move is allowed.

Judge Folsom is likely to deny the transfers, but Verizon and ATT/MS are likely to appeal. While odds are against them on appeal, they must be motivated by the fact in the past two years, the appeals court granted 4 such petitions out of the E. TX court after the judges there refused to transfer their cases, which was unheard of before.

Charlie said right before the en banc order that he was willing to pay TiVo $120M a year lump sum to settle the case and have E* and TiVo "work together." I suspect after the en banc order he is no longer feeling so generous.

I think maybe the en banc order is about to weaken what ever Judge Folsom has to say about the whole business.

Today the appeals court again granted a petition for writ of mandamus, ordering the E. TX court to transfer a patent case out of its own court, to a different district court. This is the fifth one. It is very important to note that in this case, the appeals court dismissed the argument made by the E. TX court that there is another concurrent lawsuit involving similar/identical patents pending in the E. TX court.

With this latest decision by the appeals court, I am almost certain Verizon and ATT/MS will appeal, if Judge Folsom denies their motions for transfer.

To grant a petition for writ of mandamus, the appeals court must conclude that the lower court had made a decision that was "patently erroneous" and the petitioner was left with no other remedy but to seek the relief by the appeals court.

I think five of such orders issued against one district court (unheard of to begin with) by the appeals court in a relatively short time period, should have some significant impact on how parties assess their positions in those patent cases in the E. TX court, especially if the cases are pending review by the appeals court.

Pretty much is saying that Folsom doesn't really know what he is doing in these type of cases then. Time for them to pull all of these type of cases out of his jurisdiction. I wonder if he has been benefiting in some way from his rulings? Hmmm. ;):rolleyes:

East Texas is known for being very "friendly" to patent holders, and that's why you see a lot of cases there. These companies will find any excuse they can to have their cases heard there. I think that's why there are an unusual number of cases get transfered back out. Those excuses don't hold up very well.

These forced transfers only started two years ago, which was my point, the appeals court has finally gotten fed up with it. Also each of those 5 orders read more critical of the E. TX court than the previous one.

This latest one did not even go into too much depth to explain why than the other four, it basically called the patent owner's game a shame, of course the E. TX court was part of the game.

BTW, this last one was not Judge Folsom's case, rather Judge Ward's. Although one of the previous ones was Judge Folsom's. It is also important to note that initially the TiVo v. Verizon and ATT cases were assigned to Judge Ward, he then reassigned them to Judge Folsom. At the time I speculated that the reason Judge Ward did so was likely because he knew Verizon and ATT would try to move the cases out of his court, by assigning them to Judge Folsom, the chances were better that Judge Folsom could keep them, because Judge Folsom was involved in the TiVo v. E* for years already.

And because of that, I say Verizon and ATT still have an uphill battle on the motions to transfer, but this latest appeals court decision can only strengthen their resolve. I think this order also strengthen Charlie's position as he assesses his outlook of his appeal, not that he was ever hesitant to appeal before:) only that he is even less likely to settle with TiVo. On that note, it is not necessarily a good thing, I continue to believe it is better for E* and TiVo to work together. But the latest news coming out of the appeals court and the PTO might just have gotten Charlie thinking that he could get rid of TiVo in the end.

Has anyone noticed an FF stutter with 713? I used to be able to hit FF a few times and skip smoothly. After 713 (maybe 712), when I skip forward, there is a definite stutter for as many times as I have pressed FF.

Can anyone check on this and report back? Recorded programs and then press skip forward a few times to see if it's smooth? Normally, it just jumps to the right place after the skips.

I'm getting fabulous picture on Ch. 148 4k, but zero audio with H713. This is with a recorded show (Notre Dame game). Anyone else have this? Audio is fine on every other channel.

My wife mentioned that her remote is acting strange this morning. She hit FF and it went to 15x FF.

Had a customer call recently saying their remote was really acting up, some buttons no longer functioned. Told them to reboot the Hopper....problem fixed.
Wife bought me a t-shirt that has "have you tried turning it off and on again?"

It's a known issue.
For a temporary fix, go into the menu, Audio, and turn Dolby Audio "OFF". You will have PCM stereo audio.

I was able to give the tech ops team some data logs so they could diagnose the problem, and they rolled me back to H708 temporarily. It fixed that issue.

They let me know that they understand what caused the issue, and it will be fixed within a few weeks in a new update.

I guess they will be busy when lots of people start asking for rollbacks to H708 now that you mention that downgrades of software does exist because it will likely fix the OTA Single Tuner and the IR Remote problems in H710-H713.

I think they were more of a transitional receiver bridging the VIPs to the Hopper. They were a PITA to install and were buggy. Personally, I thought at the time that they were the best receiver out there. The versatility of the VIP's with the new Hopper GUI and, by far, the coolest-looking front plate and lighting.

Well if it is because of reliability that wouldnt shock me.I went through 5 or 6 of them in little over 2 years. I loved the Sling when it worked! Saved lots of money having it in the day. That was probably 15 or 16 years ago?

I don't recall that they came out just before hopper, but rather that they came out even before 722. Or could be thinking of 921.

As to the title pf the post, "rare" does not necessarily mean valuable or desirable.

You are thinking of the 921. The 922 was the first DVR with Sling functionality built in (that was eventually disabled along with the Sling Adapter for the 722s and the 1st Hopper because they relied on now-defunct Adobe Flash technology). With the bugginess described by others and the removal of its marquee feature (Sling) the 922 faded into obscurity once the Hopper 2 with built in Sling was released and they finally made the concept into a fully functional product.

I had one, the front panel lighting was cool, the menus were fresh and a lot more modern looking than the ViPs. However, it was very buggy and the Sling functionality just didn't work well - I think it was due to internet speeds at the time. I think I had to pay $40 for the Sling app on my phone iirc.

The future of Stargate is in question today, as SCI FI Channel has cancelled the long-running Stargate SG-1, Multichannel News reported today and a GateWorld source has confirmed. The news regrettably follows the airing of the show's milestone two-hundredth episode on Friday.

Stargate Atlantis, meanwhile, has been renewed for a fourth season, with the network hoping to see that the spin-off series can stand alone, according to a source.

Well, there are a couple involving the Antarctic. "Solitudes", S1 E17 (one of my favorites), Then, "Lost City', S7 E21 and E22. Then, in the SGA pilot, "Rising", S1 E1 and E2, it starts out in the Antarctic for about the first 20 minutes or so.
