Hello everyone.

First, let me start by saying that I've read through quite a few threads on here related to the same subject to see if I could have my question answered. I've read over the OTARD regulation and completely understand that it is within my right to install a satellite dish and the MDU can't prohibit this so long as I abide by certain guidelines - no drilling, can't eclipse the space of a patio, etc - and install it in an exclusive use area - in this case, my back patio which can only be accessed through my apartment.

I will be moving into my first apartment in about 3 weeks and knew upfront that the complex provided renters with only one TV/Internet choice: some Mom 'n Pop "cable company" that acquires a Dish Network signal and then pumps it into all of the properties they own in the area. I was fine with that at first because we love the place and I figured it was within their rights as owners to restrict the service for what would be obvious reasons. In fact, we love the place so much that I ignored the fact that their Dish Network feed (admitted to me multiple times) would cost $20 more per month on each package due to extra fees and more expensive services. It wasn't until this week that I found out about the OTARD regulations and that I actually had a choice should my back patio have LOS.

I just had a not-so-lovely discussion with my soon-to-be property manager over the phone and one of her office lackeys. I first called and politely inquired about any restrictions for installing satellites (knowing full well what she'd say) and the office assistant sternly informed me that I had no choice but take what they provided. She brushed off my sob story of being a current Dish subscriber and said she was sorry but that I had no choice. I then, still politely, asked her if the management was aware of the FCC regulation prohibiting them from not permitting my installation. She hung up.

I called back and got the property manager (who must have been listening in the whole time) and said she was fully aware of the law and that it didn't matter; they were a special case and the regulation didn't apply to them and that it was written into their lease that you couldn't install anything. I calmly asked her to clarify and she said that since they were a private property, that they were within their rights to deny your installation. I asked if that even included in my exclusive use area on the back patio and she said it did include that area as they consider the private patios attached to their units as common areas. At least there's no conflicting terms there.

Where I'm foggy on the OTARD, and where I might have an issue pressing my case, is as follows:

Q: If my association, building management, landlord, or property owner provides a central antenna, may I install an individual antenna?

A: Generally, the availability of a central antenna may allow the association, landlord, property owner, or other management entity to restrict the installation by individuals of antennas otherwise protected by the rule. Restrictions based on the availability of a central antenna will generally be permissible provided that: (1) the person receives the particular video programming or fixed wireless service that the person desires and could receive with an individual antenna covered under the rule (e.g., the person would be entitled to receive service from a specific provider, not simply a provider selected by the association); (2) the signal quality of transmission to and from the person's home using the central antenna is as good as, or better than, the quality the person could receive or transmit with an individual antenna covered by the rule; (3) the costs associated with the use of the central antenna are not greater than the costs of installation, maintenance and use of an individual antenna covered under the rule; and (4) the requirement to use the central antenna instead of an individual antenna does not unreasonably delay the viewer's ability to receive video programming or fixed wireless services.
As I said, they own the provider that brings in the Dish feed. Is this considered a central antenna, and if so, does this prohibit me from installing my own? My interpretation would be no, based on points 1 and 3 as I'm forced into their service of choice and it is incredibly more expensive to maintain annually. Not only that, but even though it is a Dish feed, I don't get any promos or specials from Dish -or ISpeed for that matter - making the prices even higher. All told, my bill through ISpeed will be $420 more annually based on price increases, lack of actual Dish promos and the lack of the Free HD For Life campaign (I wasn't going to purchase HD through them anyways, but the cost goes into the calculation based on the fact that it's free through Dish).

No matter the responses I get here, I see that I have three options:

- Take what they give me
- Push my case at the risk of having them make up a bogus claim come expiration of my lease and refuse to resign me
- Split my parents monthly cable bill and purchase a Slingbox to stream my TV to us, even if it means going through the hassle of hooking up a laptop to the TV every time we want to watch it -OR- buy my own service and have it installed at my parents family-owned place of business...same result really
Really, I don't know that I have much choice in the matter if I don't want to get evicted come time when the first lease expires. Illegal or not, this is the same situation at every complex we looked at in the area, so we're going to have this battle no matter where we go...it's just that we like this apartment itself. There is no "Well you chose to live here" quotient as every situation would be the same, and this city is located the best for our work travel needs going in two different directions. Plus the manager of this property has a reputation of being a real witch, so I'd rather her not treat us like trash for the next year.

I suppose what I'm asking is if you all have any other alternatives or legal protections that would make fighting their "rules" a non-issue when it comes time to sign a new lease. Or, perhaps, a complete **LEGAL** work-around to their restrictions, like using a Slingbox to broadcast a paid-for service in from a different location over the internet.

OTARD applies to EVERYONE who has access to an area which is for their use only and can place an antenna into that area without infringing on the ability of someone else to use.

It does NOT matter what the lease says.

The FCC is your friend and will intervene on your behalf, but you must do some legwork and open a case with them.

Start with this: Installing Consumer-Owned Antennas and Satellite Dishes, print it and then get a copy of your lease.

Then document your conversations, write out your notes - bullet point style, and call the FCC at the FCC's Consumer Center 888-CALL-FCC (1-888-225-5322). Be composed and take your time answering their questions.

If you have the time and can put together a well written summary, including a transcription of your conversation with the manager, along with a copy of the lease with the restriction highlighted, sent it all to:

Federal Communications Commission
Consumer & Governmental Affairs Bureau
Consumer Inquiries and Complaints Division
445 12th Street, SW
Washington, DC 20554

Be prepared for a wait if you write. They are pretty quick to respond but with all the threats being sent via US Mail, letters can be delayed by up to 30 days as they are sniffed for Anthrax and other substances. Calling is always the quickest and then you can fax any documentation they might require.

They WILL act in your behalf.

Per OTARD, no condo association, rental property owner or manager, or landlord can prohibit any OTA antenna which falls under the classification of, and within the guidelines of, OTARD.

This is pretty much any RECEIVING antenna, whether for OTA TELEVISION, SATELLITE, SHORT WAVE, FM, SATELLITE, that protrudes less than TWELVE FEET above the surface on which it is place and meets all of the other requirements stated in the OTARD regulations. With the exception of SATELLITE INTERNET, OTARD does NOT cover transmitting antennas.

There can be NO ADVANCE NOTICE required; no PERMIT, no design submissions, no fees, no inspections, NOTHING, so long as it meets OTARD specifications.

Where homeowners associations have fought back against the Commission, they have lost, BIG TIME, with the FCC taking them to court, not the resident. Go to the OTARD website and search on VERNON HILLS ILLINOIS. A wealthy condo association got fined and had their hands slapped big time when they refused to obey a Commission ruling. When the Commission kept ruling in the home owner's favor, the homeowner's association took the homeowner and the Commission to court and lost - being fined for disobeying the Commission's initial ruling. It takes a bit of time to search and read the OTARD rulings, but it is absolutely worth while for anyone who has a problem with OTARD uninformed individuals.

Remember, the OTARD rules were made for those of us who want DISH and television reception where we are otherwise restricted and fall into the OTARD acceptable use regulations.

NO ONE HAS THE RIGHT TO OVERRULE THOSE RESTRICTIONS SO LONG AS THE PLACE YOU WANT TO PLACE THE DISH OR ANTENNA IS UNDER YOUR EXCLUSIVE CONTROL - IE: NOT ACCESSIBLE TO ANYONE EXCEPT YOU, AND YOU FOLLOW THE OTARD RULES.

You CANNOT be evicted. You cannot have your lease renewal denied [Yes, the Commission has intervened in those situations as well.]

If you truly like the apartment and want a satellite dish, call the FCC and let them do the fighting for you. They will, and if you provide the necessary documentation, they will win.
Claude Greiner
All im going to say is this....

Your 100% correct on this matter and the apartment complex is dead wrong. Unless your installing in a common area, there is no a thing they can do prevent you from installing your own Dish.

But why even fight these a**holes?

Seriously, my girlfriend moved into an apartment 3 years ago and when we went to sign the lease the first thing I told the apartment manager was that we where installing a Dish.

They tried to give me crap on getting seperate insurance, Etc....

I told them if im not allowed to install a Dish im not moving in, and would find somewhere else that is Dish friendly and all of a sudden this was no longer an issue.

Its one thing to fight them after your already moved in, but if they are giving you crap and your not even moved in the place yet, I would start looking for another place and when the reality hits in with the property manager that they are going to have a vacant unit then they will give.

Every year they try to raise the rent at my Girlfriends apartment, and every year I threatened to move out citing the fact that I always pay ontime and a week early. Everytime we go through this, I win and a matter of fact last year when they pulled this crap I got them to give me $150 off my rent which is what I paid as a deposit on another apartment.

They need your business, as there is alot of empty units everywhere due to the housing market.

The other thing is that you might want to send me a PM with your address and I'll see if the retailer they want to force you to go with doesn't have the address in DISH Networks system as being exclusive to them, which would prevent you from activating or moving an existing account to that address.
M
chicagonettech, your post is very detailed and very good with a couple of exceptions. The first:
This is pretty much any RECEIVING antenna, whether for OTA TELEVISION, SATELLITE, SHORT WAVE, FM, SATELLITE, that protrudes less than TWELVE FEET above the surface on which it is place and meets all of the other requirements stated in the OTARD regulations. With the exception of SATELLITE INTERNET, OTARD does NOT cover transmitting antennas.
OTARD does not cover short wave and am/fm antennas. Here's the excerpt from OTARD:
Q: What are "fixed wireless signals"?
A: "Fixed wireless signals" are any commercial non-broadcast communications signals transmitted via wireless technology to and/or from a fixed customer location. Examples include wireless signals used to provide telephone service or high-speed Internet access to a fixed location. This definition does not include, among other things, AM/FM radio, amateur ("HAM") radio (but see 47 C.F.R. §97.15), Citizens Band ("CB") radio, and Digital Audio Radio Services ("DARS") signals.
In addition, masts CAN be greater than 12 feet in height. If they exceed 12 feet, they MAY need, for example, a building permit. Again, here's the OTARD excerpt:
In addition, antennas covered by the rule may be mounted on "masts" to reach the height needed to receive or transmit an acceptable quality signal (e.g. maintain line-of-sight contact with the transmitter or view the satellite). Masts higher than 12 feet above the roofline may be subject to local permitting requirements for safety purposes. Further, masts that extend beyond an exclusive use area may not be covered by this rule.
Just thought I'd clarify a bit.
Derwin0
Locals are probably only on one or the other though.
Pittsburgh locals are on 129, so it would be a 1000.2.

Though the Pittsburgh locals are uplinked to 77, so they might become Eastern Arc (1000.4) as well, when the new 61.5 Sat is launched.

Continuing the Kilauea thread in the Pub here. Perhaps the Iceland one too next time there's remarkable activity.

Currently there is precursory lava flowing into the crater, leading to the next episode that'll probably start within the next day.

You can see the pace of inflation / deflation here. It serves as the primary predictor for when the expect the eruptions, which coincide w/ inflation turning into significant deflation and last for several hours on average with significant fountaining.

The USGS Kīlaeua Webcam #1 has been showing overflows and doming from the North vent overnight. Maybe the volcanic plumbing has settled back into its two-three week cycle of fountaining?

But I do miss the little cinder cone that broke up in the last episode.

At 08:01 HST 11/05/2026, the North Vent produced what I would call a "wet burp" after the precursory "pistoning" events, small amounts of lava pouring out of the vent for a few seconds to minutes and then everything recedes. There must have been a gas bubble holding thing back because two minutes later the lava started flowing out of the vent in all directions. Then, at 08:25, it stopped. What a tease! I thought this was how Episode 56 started.

About 12 minutes later at 08:38, the North vent once again started overflowing and picked up steam at 08:42. By 09:00, slight doming could be seen in the pool of lava in the vent. Surely this is it!

But, 09:50 and things wind down again. By 09:57 HST there's just fumes coming out of the vent. Phooey.

But then 10:00 comes and the heavy lava flows kick in again. This time seems like the real deal. At 10:30 HST there's little spurts of lava flying up in the air over the vent, but more from gas than a steady fountain of lava. This looks promising!

11:30 HST and the color of the lava is definitely hotter, and the intensity has picked up to a definite dome and precursor to fountaining. The USGS calls Episode 56 as officially starting at 12:10 HST:

Alert Level: WATCH, Color Code: ORANGE 2026-11-05 22:29:12 UTC
HVO/USGS Volcanic Activity Notice

Volcano: Kilauea (VNUM #332010)

Current Volcano Alert Level: WATCH
Current Aviation Color Code: ORANGE

Issued: Thursday, November 5, 2026, 12:29 PM HST
Source: Hawaiian Volcano Observatory
Notice Number: 2026/H514
Location: N 19 deg 25 min W 155 deg 17 min
Elevation: 4091 ft (1247 m)
Area: Hawaii

Summary: Episode 56 of the ongoing Halemaʻumaʻu eruption began at 12:10 PM HST on November 5, 2026.

Volcanic Activity:
Episode 56 of lava fountaining in Halemaʻumaʻu began at the summit of Kīlauea began at 12:10 PM HST on November 5, 2026.

Lava fountain heights are relatively low at about 100 ft (30 meters), but will likely increase. Ground-level sensors near the eruptive vents indicate that winds are blowing from the northeast direction, which suggests that volcanic gas emissions and volcanic material may be distributed to the southwest direction from Halemaʻumaʻu.

This will all depend on the storyline. I'm not sure how well it will translate. Modern TV hasn't been all that kind to PIs and even less kind to CIs (confidential informants).

I have Dish with Hopper3. I choose to get local channels OTA and had a "guide list" established at my previous home. Having moved a few miles away, I wanted to update the list by appending a couple new stations via a rescan. As many would know, some stations come in with the UHF/VHF antenna aimed in one direction, while others come in better with a different direction.

Unfortunately, when a scan is done (bringing in 25-30 stations for that particular antenna aim), the dialog screen does not present the established guide list; it presents an empty field to the right that the scanned stations may be selected one by one and added to the empty guide. But because of antenna aim, some stations originally saved are missing, and would have to be retrieved with a different antenna aim. But as I explain, if a 2nd scan is done with a different antenna aim, the stations saved from the first scan are lost.

It troubles me that Dish didn't develop software that would allow a user to simply append only 1 or 2 channels to the established list.

Any thought on this? Has anyone experienced this or heard of this from others?

I could very well be wrong....it has been a LOT of years but back when I had a 722K it seemed like when you went back to the scan screen that you could just scan again and it would ADD those channels to the previous list or you could delete the previous results and only add the channels from the new scan.

I am not sure about that but I do know that you could manually add additional channels just by entering the actual RF channel number and the older receivers would add the virtual channels to your list

Like I said.....that has been many years ago. Swapped my 722K for a Hopper in 2012.

It does seem like I remember having to delete the existing channels when we did a rescan. Back then our local stations KEPT monkeying around with things and it was non-stop complaints from customers about their channels not coming in. Got so bad that I stopped selling OR installing OTAs....something I had been doing since 1984 so you know it HAD to be pretty bad.

Keep in mind that the 722 had a built in OTA tuner and the 722K had a plug in module for OTA. The Hoppers and Wallys use an add on USB OTA dongle. I believe they are entirely different.
