Ex-EchoStar exec files discrimination lawsuit
She alleges 'yelling fits' by CEO Ergen were demeaning

By John Accola, Rocky Mountain News
January 14, 2005

A highly paid executive who abruptly resigned a year ago from EchoStar Communications has filed a discrimination lawsuit alleging she was subjected to "violent yelling fits" from company founder Charlie Ergen.

Soraya Hesabi-Cartwright, a former executive vice president, faults EchoStar's management for standing passively on the sidelines while witnessing Ergen's alleged abusive behavior.

Her lawsuit, filed Monday in Denver federal court, describes EchoStar as a "boys club" that discriminated against her on the basis of sex and national origin.

The 44-year-old plaintiff, an Iranian-American who joined EchoStar in 1994, is seeking unspecified damages for emotional distress and mental anguish in addition to reinstatement and $4 million in lost stock options.

EchoStar spokesman Steve Caulk said the allegations are without merit and that "EchoStar will prevail at trial."

"EchoStar has always been a equal opportunity employer, and we are disappointed that Hesabi-Cartwright . . . has chosen to file a lawsuit," EchoStar said in a statement. "We cannot speculate on her motives for filing."

The Douglas County satellite-TV provider noted that Hesabi-Cartwright, who oversaw EchoStar's Dish Network subsidiary, was one of Colorado's highest-paid executives, with compensation in 2003 of more than $13.5 million.

Hesabi-Cartwright, of Lone Tree, could not be reached Thursday. Her attorney, Robert Truhlar, said he was "too busy" to discuss his client's current employment status and circumstances.

Her lawsuit cites a series of confrontations with Ergen, EchoStar's chairman and CEO, that escalated into personal and demeaning tirades in which she was berated in front of other senior executives.

The lawsuit describes a December 2003 incident in which Ergen "yelled and screamed" at Hesabi-Cartwright after one of his folksy "Charlie Chat Broadcast" TV appearances to Dish subscribers.

"This hostility escalated until it was unsafe and intolerable for Ms. Hesabi-Cartwright to continue her employment with EchoStar," the complaint stated.

In January 2004, Hesabi-Cartwright quietly left EchoStar without a company announcement.

At the time, trade publication Multichannel News noted that the senior executive was no longer listed with the other officers and senior managers on the company Web site.

"I would say that she will definitely be missed," an EchoStar spokesman told the publication.

"We wish her all the best in her future endeavors," the spokesman said.

Having been a csr then moving up to managing them, I can say that great conviction that 99% of all csr problems start at the top of the company and work their way down.
A lot of companies view teir 1 support as just a call clearing house. Give people scripts to read and follow, document if it did or didn't work then escalate the call if not resolved. Don't do anything that isn't on the script and did what you need to asap so you can handle the next call. Most times it doesn't even matter if you could right a script for them to follow to solve more complex issues - can't do that if it would take too long. They get a lenght of call in their heads and no call should take longer. PERIOD!
I try to compliment good csr's and take deep breaths when dealing with bad ones. Mostly, they are only doing their jobs the way they have been told to do them.

People like her need to grow the heck up. I hate people calling out discrimination in situations like this. There are things you can do WAY before actions like these are needed. Most companies already have certain people within assigned to help people claiming discrimination. There are other companies out there too to help if the people cant get results that way. She is greedy and needs to see what it is like to have no $$$. Man, pisses me off to see people getting paid that much and still want more more more ...

This lady just wants to get paid but hope she just gets the thrown out....

I apologize for my CSR bashing message, but it did emphasize the point I was trying to make. Cartwright was in charge of customer service. Someone stated that 99% of the CSR's problems come from upper management.

I agree, which is why I stated she probably deserved being yelled at.

Having first level CSR's be nothing more than script readers and advanced telephone switchboard operators... that's just dumb. An automated system can take care of that and be WAY more efficient with it. Move them over to marketing and let the CSR's who know a thing or two filter out what needs to be filtered out.

It would also help CSR's out if they had one set of rules to play with. Custom labor for example.

RSP's: Customer pays for custom work. Can't afford to brunt the cost.
DNSC's: Tech works hourly, git 'er done, big corporation brunts the cost.
Retailers: Forced to do it in order to complete the sale.

I know an agent in TX, we email often, apparently she wanted to learn tech support more than the typical check connections, run a check switch, and if it doesn't work we have to charge a check switch. Thats when she found this site, really great for helping let people know whats going on. Upper management found out and threatened her job, saying that her could tell people how to use the system. Still comes without logging in or posting. Agents do come, threats of jobs go far to dissuade people from learning from outside sources though. I give agents like Jane a way to go, if more people actually sat there watching the chats, reading over retail chats, and going to this forum when they get home from work. If there were more like her and a more friendly enviornment for agents to develop skills and not be going for just the paycheck we wouldn't have this problem.

If the issue isnt nothing more than changing programming or asking a very simple question I have to hang up and try another CSR or talk to a Supervisor in which does not or will not do anything to resolve the problem or dont know how to a lot more times than I should. I have had some snotty mean ones and I have had some pretty sweet ones that I could talk to for hours (and have a good while back).

Sometimes a thread gets so many posts in it that is can cause issues for the server so that why today we introduce The Song Name Game Part 3!

So let the game continue!

The last song was added by Bobby who posted...

One Meat Ball - Andrews Sisters

CONTINUE ON AND HAVE FUN! WELCOME HOME TO SATELLITEGUYS.US!

Here are the original rules for the game as posted by WebbyDude back in 2006. http://www.satelliteguys.us/threads/68645-Song-Name-Game

Just name a song title and the band who performed it. The next person does the same thing, but needs to list a song title or band name which includes a word from the previous entry. Pick songs from any genre.

Example:

Long Live Rock and Roll -- Rainbow

Rainbow in the Dark -- Dio

Another example:

Ride the Lightning -- Metallica

Lightning Strikes -- Ozzy Osbourne

Get it?

An additional note: we all know that song titles, sometimes, use profane words. Because this is a family friendly website it is advised that you clean up that title up a bit. This is accomplished by using something like sh!t instead of the real word. Thanks....

Finished season 3 last night. Still one of my favorite shows.

Anyone else wonder if there might be something else going on with Callum? Seems to me he has too much access to Russian intelligence.

Over the past few weeks, I have had problems connecting to streaming services (Netflix, HBO et al). When I go to the TV's native Channels, I have no problem. The Dish internet troubleshooter shows I have a good internet connection. I'm wondering whether it's an issue with my internet provider or a problem with the Dish software on the Hopper Plus. Anyone else seeing this?

I have a DISH Hopper 3 (Software H713) with Hopper Plus (Software P15403). I have not tried streaming services but I primarily watch TVB Jadeworld international package which is only available by streaming and when I have an issue, I usually have to go to a non-streaming satellite channel first before the streaming channels will work again. What software versions do you have and what is the error message if any are showing on your screen? or is that Dish downloading logo just stuck and never finishes?

I'm on H713 on the Hopper and P15403 on the Hopper Plus. It shows internet connection issues and doesn't finish loading the various services. I see the "loading circle going around. Sometimes I get a message saying that the service is having trouble loading my content and to check the internet connection.

Did it ever work correctly before? Hard to say what the problem is. Usually for streaming, it will show the Dish logo with lines sweeping down to show downloading, never seen the circle issue. Did you try a manual reboot, red button reset, power cord unplug/replug to see if it makes a difference.

Might be worth just to ditch the hopper plus. No issues here on h713

Buy a roku and dump the hopper plus you'll be better off. If you have a smart tv you don't need either one. No hopper plus here and no issues!!!
