I have been corresponding with Dish Network's sales tax department, via e-mail, since the beginning of April, 2011, regarding sales taxes on our account.

Prior to that I called several times - to no avail, and also PM'd one of the reps who responds on this site, all to no avail. Either I got no response or I was told by a CSR that this was not a problem that needed fixing.

We have seen sales taxes, in the amount of $0.48 per month, going back as far as I can find our bills.

We are an original DN customer from the early 90s who own all of our equipment. It is all self-installed.

We do not rent content or anything else.

Neither Chicago, Cook County, or the State of Illinois currently have any kind of tax on satellite television, services, or delivery charges.

Included below, with account information redacted, is my correspondence, along with the response I finally received, from the Dish Network sales tax department.

The Illinois Department of Revenue is actively monitoring this case as well.

Moral of the story: WATCH YOUR DISH NETWORK BILLS CAREFULLY AND MAKE CERTAIN YOU AUDIT EVERY ONE OF THEM BEFORE YOU PAY THEM! Not only does Dish Network throw legal increases into billing, but they are fully capable of sneaking other line items in which are not legitimate.

?
To Whom It May Concern;

I am writing at the suggestion of the Illinois Department of Revenue who has
asked me to contact you to explain why I am being billed for SALES TAX on my
Dish Network Statement in the amount of $0.48 every month.

Illinois presently has no sales taxes on services.

Illinois presently has no sales taxes on satellite services.

The City of Chicago presently has no sales taxes on satellite services.

I own all of my receivers and my satellite dish. Everything was purchased over eBay and self installed.

I do not lease anything from Dish Network, therefore you cannot collect any leasing taxes for the City of Chicago.

Please either provide an explanation as to the reason for the collection of sales taxes on my account, 8255-XX-XX-XXXXXXX, or immediately discontinue the collection of those taxes and refund all such taxes collected on previous statements.

The Illinois Department of Revenue is also receiving a copy of this correspondence.

If you need to contact me, please respond to this e-mail. If you need a copy of my bill, I will be glad to fax it to you.

I look forward to seeing your response.

Thank you,
Bruce Barnes

This message was originally sent on Friday, 1 April, 2011.

I have not heard back from anyone in the consumer tax department at Dish
Network. This is NOT RESOLVED.

We are being charged SALES TAX in Illinois. We OWN the equipment. It is
NOT LEASED. There is NO SALES TAX on SERVICE in Illinois.

The Illinois Department Of Revenue is also interested in having your response forwarded
to them as they have stated you are not submitting sales tax to them.

Please respond within 72 hours or we will terminate our Dish Network account.

My cell phone, at 773.XXX.XXXX, is the best way to contact me.

Dear Mr. Barnes,

I apologize for the frustration; we have been researching your concerns. The tax is being charged on the DVR Fee and we are working with our IT department to fix this.

I will contact you as soon as I have an update.

Sincerely,

Calling Dish Network or opening an online chat with a CSR will NOT resolve sales tax issues.

DN CSRs CANNOT change your tax rate or investigate sales tax issues.

Sales tax questions and issues MUST be handled by the Dish Network accounting department.

there are a lot of things that are weird and do not add up..i.e...

texas state tax = 6.25%
cities add on another 2% for 8.25% at most local retailers.

on a $89.99 bill, there is $5.75 state/local tax--> that equates to 6.39% ???????????????

don't know how old this is....
T

From what I could find in TX, the first $25 is not taxable (and don't ask me why cause I would have no idea). It is weird but it calculates perfectly knowing that little bit.

Also, as I mentioned to the OP in PM, if you have a question regarding tax, or a tax dispute, contact consumertaxissues@dishnetwork.com. Also, if you have an 'exemption' please mail a copy of your exemption certificate to 9601 Meridian Blvd. Englewood, CO 80112 ATTN: Tax Department or email it to exemptioncertificates@dishnetwork.com.

Chicagonettech, from what I could find when I initially spoke with you was that any fees are taxable, and DVR FEE is a fee. As others have suggested it is not 'equipment' unto itself, and it is not programming, and it is not a 'service' we provide, but a capability of the box. In order to use a box with that capability, there is a fee. While the language of your response from the people I directed you to does seem to insinuate that there is an issue, rest assured that before anything is changed and/or refunded, the charges will be verified (or negated if I am indeed wrong). I did spend a lot of time researching the issue when you first contacted me, and based on the language of the tax laws, I would still say I was correct in my initial assumption with you in PM. However, being that I do not work in the legal department or tax department, I will concede that the information I gave you (and now this thread) was correct in how to deal with this sort of dispute.

here is another list:

Sales Tax on Satellite TV Service

still doesn't make sense from a bill of ($69.99 AT250 + $6 DVR + $7 solo + $7 soloHD = $89.99). no combination of these charges taxed @ 6.25% comes to $5.75. Of course, something else if funny:

02/20/11 = $95.94 tax = $5.95
03/20/11 = $95.74 tax = $5.75

same service, same place, no changes at all- difference amount of tax ???

TonyT - In Illinois there are NO TAXES on ANY FEES or OWNED EQUIPMENT for satellite services.

The consumer tax division has resolved the problem in the tax portion of the billing program and removed those taxes from my bill. They are also issuing a credit for all prior taxes charged. I received notification of the resolution of the issue from them this morning.

Taxes are not, as of yet, governed by any Federal law or regulation. They are a state-by-state issue. Illinois does not tax satellite services or OWNED equipment. Therefore, Dish Network is not allowed to collect those taxes.

They CAN collect sales tax on equipment SOLD in Illinois by a venue with a PHYSICAL PRESENCE in Illinois.

They SHOULD BE collecting taxes on LEASED EQUIPMENT in the City of Chicago - at the CITY OF CHICAGO LEASED EQIPMENT FEE RATE.

They ARE NOT ALLOWED to collect taxes on wholly owned equipment or services.

They ARE NOT ALLOWED to collect taxes on the SHIPPING portion of the SALE of any equipment shipped to Illinois.

Once the actual credits are applied to my billing, I will forward the entire conversation with the Sales Tax Department, along with the applicable portions of the comments made in this forum for them to review and close the case for my specific account.

Since this was opened with the Illinois Department of Revenue, however, I suspect they will be conducting an audit of Dish Network's sales tax collections for customers within Illinois to make certain they are in full compliance in the future.

That is weird, but does not completely rule out simple ledger charges/credits. Could you PM a phone number on the account? I could probably better explain what is going on seeing it for myself on the ledger.

Chicagonettech, I am glad the direction I sent you provided a resolution.

if it is different next month, it will be posted. changes were done in January when the multi-sport was dropped, and then the new fees came in February.

nothing was done after that, so the bill should have remained the same. we will see, but neither add up correctly with posted tax rate.

I live in Missouri and I too see the sales tax on "leased receivers." I pay $2.58 per month for a Hopper w/Sling and two Joey's. I NEVER paid sales tax on leased receivers with Directv. That leads me to believe that one of them isn't doing something right. Unless, of course, Directv pays Missouri the sales tax on it's equipment at time of purchase, and Dish collects it retroactively and pays it to the state later. Does anybody know? Seems suspicious to me that one does and the other does not!

Sometimes a thread gets so many posts in it that is can cause issues for the server so that why today we introduce The Song Name Game Part 3!

So let the game continue!

The last song was added by Bobby who posted...

One Meat Ball - Andrews Sisters

CONTINUE ON AND HAVE FUN! WELCOME HOME TO SATELLITEGUYS.US!

Here are the original rules for the game as posted by WebbyDude back in 2006. http://www.satelliteguys.us/threads/68645-Song-Name-Game

Just name a song title and the band who performed it. The next person does the same thing, but needs to list a song title or band name which includes a word from the previous entry. Pick songs from any genre.

Example:

Long Live Rock and Roll -- Rainbow

Rainbow in the Dark -- Dio

Another example:

Ride the Lightning -- Metallica

Lightning Strikes -- Ozzy Osbourne

Get it?

An additional note: we all know that song titles, sometimes, use profane words. Because this is a family friendly website it is advised that you clean up that title up a bit. This is accomplished by using something like sh!t instead of the real word. Thanks....

Continuing the Kilauea thread in the Pub here. Perhaps the Iceland one too next time there's remarkable activity.

Currently there is precursory lava flowing into the crater, leading to the next episode that'll probably start within the next day.

You can see the pace of inflation / deflation here. It serves as the primary predictor for when the expect the eruptions, which coincide w/ inflation turning into significant deflation and last for several hours on average with significant fountaining.

Wife and I like the AfarTV feeds, for the discussion along w/ them, though they're otherwise just mirrors of the official USGS feeds.

Oooo, quite the show now. All three vents have doming and overflows. The cone that built up around the North vent lost its upper quarter at 02:50 Oct 17 and is now spewing lava at a healthy rate. Don't know if I would say it's a fountain, but it's close.

edit: The USGS has called the official start of Episode 55 as starting at 03:19 HST Oct 17, 2026:

Alert Level: WATCH, Color Code: ORANGE 2026-10-17 13:43:56 UTC
HVO/USGS Volcanic Activity Notice

Volcano: Kilauea (VNUM #332010)

Current Volcano Alert Level: WATCH
Current Aviation Color Code: ORANGE

Issued: Saturday, October 17, 2026, 3:43 AM HST
Source: Hawaiian Volcano Observatory
Notice Number: 2026/H488
Location: N 19 deg 25 min W 155 deg 17 min
Elevation: 4091 ft (1247 m)
Area: Hawaii

Summary: Episode 55 of the ongoing Halemaʻumaʻu eruption began at 3:19 AM HST on October 17, 2026.

Volcanic Activity:
Episode 55 of lava fountaining in Halemaʻumaʻu began at the summit of Kīlauea began at 3:19 AM HST on October 17, 2026.

Fountain heights are relatively low at about 100-150 feet (30-45 m), and it is not clear whether this episode will evolve to the same heights as previous episodes. Continuous overflows from the vents began yesterday, October 16, just before 6 a.m. HST and transitioned into episode 55 fountains at 3:19 a.m. HST this morning. The current forecast is for winds are blowing from the north-northeast direction, which suggests that volcanic gas emissions and volcanic material may be distributed to the south-southwest direction from Halemaʻumaʻu.
  • All eruptive vents and lava flows are confined to Halemaʻumaʻu crater within Hawaiʻi Volcanoes National Park. Tephra fall from volcanic ash clouds is greatest within 3 miles (5 km) of the vents, lighter ash and Pele's Hair may stay suspended for large distances from the vents.
Foxbat
Kīlauea seems to be returning to the "normal" eruption script, impressive fountaining from the North Vent. For once, the V2 Cam has the best overall shot:
IMG_1535.webp
The lava flows have covered a good portion of the Halemaʻumaʻu crater floor.

Since it was already "paid" for, I spent the two hours of my time watching the John Cena action movie on Apple TV, "Matchbox The Movie" even though the reviews were brutal. It was better than I expected, so I didn't feel like I had wasted an afternoon watching it. But it felt like another "Reacher"/"Neghley"/"Mission: Impossible"/"Fast & Furious" crash and blow stuff up with lots of automatic gunfire mixed in movie featuring covert CIA operatives.

I don't think we'll get a follow-up movie from this. I expect Mattel will have other toy lines to exploit.

Swaggerty's isn't too bad, sausage prices are lower per lb than making my own from pork butts right now so I've been buying JC Potter or Owen lately.
(Swaggerty's at Sam's is pre cut, I usually partially freeze the rolls and cut with my slicer and vacuum seal on parchment paper)

I don't think Tim and Tony are that far apart in Age ...

Remember what Tony said to Tim when they first got back together ...
Tony said: I am the New Tony, Tim .... (something to that effect)

Tony has changed, he's been running his Security Business ... I'm sure he has grown up.

Give it time ... your judging the New Tony from the old Tony.

It sounds like Tim won't be around the Team much longer either.

I'm curious how they are going to implement Tony into Origins (If they do) ...
Tony was introduced to Gibbs and the team, on NCIS, which makes it the Mothership side of things, he worked in Baltimore prior to NCIS, NO mention when they met that anyone had known one another ...
