Andrew Kantor: CyberSpeak - Digital Content Protection Act would be consumer disaster Andrew Kantor, USA TODAY
Sat Jan 28, 10:05 AM ET

Here's a scenario: You can pay for a ticket at your local movie theatre, or you can hop a small fence and sneak in a back door that you know is open.

Being a generally law-abiding person, you pay for your ticket. (Besides, hopping that fence is annoying and you do worry a little about being caught.)

But then the movie theatre starts adding some new rules for ticket holders. First it starts telling you where you have to sit; you don't get a choice. Then it requires you to sit through all the commercials; no arriving a little later. Then it requires you to buy a certain amount of candy or popcorn.

It justifies all these things by explaining that it needs to keep its revenue up in order to continue to bring you the movies you enjoy.

You follow these rules, even though they start to get annoying - you don't really enjoy having your movie-going experience controlled more and more by the theatre. Further, as the theater's rules increase, you notice more and more people hopping that fence and sneaking in the back.

At what point will the rules get so annoying that you start sneaking in the back?

Hold that thought.

Bad business

When it comes to home entertainment - music and movies - the Senate is considering making those rules a lot more annoying. A bill was introduced by Sen. Gordon Smith (news, bio, voting record) (R-Ore.), it's called the Digital Content Protection Act of 2006. It's designed to give the FCC (and, let's be honest, the movie and music industries) control over the capabilities of home entertainment technology.

The government, rather than the free market, would be able to say what capabilities a new device could have. And you can bet the entertainment industry would have a big say in that.

If this was law a few years ago, the entire digital music movement would have been stopped in its tracks. See, the RIAA fought tooth and nail against the Diamond Multimedia Rio PMP300, eventually losing in federal court. Had the DCPA been in effect, Diamond never could have made it; the FCC would have said No. (Note to purists: The Rio was not the first MP3 player. That honor goes to the Eiger Labs MPMan, built by Saehan in Korea.)

No portable MP3 players would likely have meant we'd be stuck with $18 CDs and clunky players and other RIAA-approved devices.

TiVo and other digital video recorders? Forget it. The entertainment industry, through the FCC, would have said No.

In short, this bill is designed to crush innovation, because the entertainment industry is unable to handle it. Its content and revenue model is stuck in the 1990s, and the people running it don't have the business sense to keep up with the digital times. They need to beg Congress to pass laws protecting their business model.

Last I checked, that ain't how capitalism worked.

Newspapers are still in incredibly profitable business, but people in it know that the Web is the future. So papers are moving online in a big way. You don't see the major papers demanding that Congress grant the government the right to regulate online news.

Good businesses change with the times. Or they die trying.

Your innovations, please

Here's how it works. The DCPA would allow the FCC to regulate any device capable of moving content around. Can you transfer content to it from your computer? It's regulated. Can it convert music or movies from one format to another? It's regulated. Does it have output jacks? It's regulated.

What features couldn't the FCC regulate? Only which permit "customary historic use" - such as playing music and making low-grade copies.

In other words, the government would have to approve any new features in any digital entertainment device. Again, imagine this had been in place a few years ago. A feature to compress audio? You can bet the RIAA would pressure the FCC to ban it. Record a TV show to watch later? No, thanks. The ability to create a mix of your favorite songs for the car. Uh-uh. Make a backup of a hard-to-find CD? Not a chance.

In one fell swoop, this bill would give the FCC the right to authorize - or ban - innovation. I hope you like your 2006 technology, because if it passes that's where the U.S. is gonna be stuck.

This new law that the entertainment industry wants passed will mean that the music or movies you get legally will come with more restrictions than what you'll be able to get illegally.

Because, as we've all seen over and over, anti-piracy measures don't stop the hackers who really want to crack them. Every time a new method comes out, someone finds a way to beat it. It's a losing battle, but one the entertainment industry insists on fighting.

Sure, these techniques stop the low-hanging fruit - the people who might want to make a quick, illegal copy of something for a friend. But the cost of that, as Sony learned when it came up with an anti-piracy scheme that actually damaged users' computers, is that you end up hurting the people who buy and use your product legally. (Sony, by the way, is facing a lawsuit from the state of Texas; possibly suits from Florida and New York; class-action suits in the U.S. and Canada; and possibly criminal charges in Italy.)

Anyway, this is where my movie theatre analogy comes in. As the entertainment industry puts more and more restrictions on what you can do with the media you own or receive, getting free and unrestricted content, even illegally, will simply get more and more appealing.

It goes against common sense that a version of a song or movie you buy should come with more restrictions than one you can steal.

So the big-time pirates - the kind folks who burn thousands of DVDs for sale on the streets of Beijing - will be unaffected. And a good number of people who are affected will start using file-sharing software to get better-quality copies of their entertainment.

And there's the irony: People who simply want to exercise their legal rights under copyright law - to make a backup copy of their music - will be forced to get their entertainment illegally. And the people who obey the law will find they're getting less and less value for their money.

Well, the bag can't weigh that much, right? But by law food product packaging must display the actual net weight of the product, i.e., the contents of the container, so by any logic, if not law, a store's stated per-ounce cost should reflect that figure. But since there's not any law regulating shelf statements, a store can say whatever it wants without violating any rules. So I guess the answer is more consumer legislation. Or simply caveat emptor.

.a bag...not much
Well, according to the price per ounce on that first bag of coffee he mentions, that would mean the bag weighed over 6 ounces. That bag does NOT weigh 6 ounces. According to Google, an empty bag weighs half an ounce.

I would think that the Vendor/Maker of the product would have a say in it, showing the Correct weight ...
You would think it would be in the contract.

I do look at the ounces of items, but unless its way off, I don't check the math, may have to start now.

Remember when you use to get a 13.5 oz bag of Chips .... Thats a PARTY Size now.

Products sold by the ounce, pound, etc, should always be priced for the product only. Only the shipping weight should include the packaging.

Unless the specific product or its packaging is known at the time of weighing, estimating the tare weight for a PoS system is a tall order.

I'm pretty sure that produce bags can't get any thinner. ;)

You certainly don't want to put unbagged produce on a belt, scale, or in a clerk's hands (gloved or not).

I would think that all the packaging would already be accounted for ... they weigh the container, subtract that from the scale, then add the product , so its weighing the Product only

You would be thinking wrong when it comes to goods that are sold by weight (meat, produce, nails). Those items typically go on the scale wrapped without an associated tare. The weight only excludes the sticker because it hasn't been printed yet.

Perhaps only for sliced meat and cheese. Salads and similarly "shifty" or "drippy" items are typically weighed in deli cartons of some sort.

My monster burritos (up to two lbs.) are weighed in their foil jackets or paper mache take-out trays, and the jacket/tray is then "sealed" with the printed label as it comes off the printer.

Precision has to give way to practicality in situations like that.

What ever I get out of the Deli is put into a container when I ask them for it, they weight the container and then add the deli product, thats the way its suppose to be, if the rest of the world is screwing you, you should try the place down the street.

You mean you were pirating the VCII and entering "Wizard numbers" every month after key change? GI finally resorted to changing out the keys twice as often, then even more often, down to just hours, making it mostly untenable?

When i was a kid, i used to salivate envisioning me having a Cband dish. It wasn't until about 1995, I installed my first Cband dish, and i remember it took me about 2 weeks to get that dish aligned properly.. This was before internet, and i had to call and talk with people on the phone about advice on how to properly tune the dish. I can't remember the receiver, but it had a UHF remote. I had the satellite receiver in the living room, but i ported it to two TV's, one in the living room and one in the bedroom. It was so nice being able to control the receiver with the remote in the bedroom about 40 feet from the living room. I remember watching Rosanne feeds where it would air the entire week in succession. Nice nostalgia.

In order to participate in any Cutting Edge testing, you must sign a Non Disclosure Agreement (NDA). Attached are a .docx (Microsoft Word) and PDF version of the latest DirecTV NDA. I found it easiest to complete the .docx version then paste a photo or scan image of my signature, cropped closely to just the signature into it as a picture. Then set Word to wrap text around the picture so that the picture follows the text "Signature".

People who have better PDF tools than I do may prefer that version.

When you apply for any Cutting Edge testing, you will be told how to send the signed copy.

There were some technical issues during the pregame, where 668 was showing the Pacers feed instead of the Timberwolves feed until a few minutes before the game.

On the stream API it looks like some areas need the Sports Pack, what's his zip code?

Sometimes a thread gets so many posts in it that is can cause issues for the server so that why today we introduce The Song Name Game Part 3!

So let the game continue!

The last song was added by Bobby who posted...

One Meat Ball - Andrews Sisters

CONTINUE ON AND HAVE FUN! WELCOME HOME TO SATELLITEGUYS.US!

Here are the original rules for the game as posted by WebbyDude back in 2006. http://www.satelliteguys.us/threads/68645-Song-Name-Game

Just name a song title and the band who performed it. The next person does the same thing, but needs to list a song title or band name which includes a word from the previous entry. Pick songs from any genre.

Example:

Long Live Rock and Roll -- Rainbow

Rainbow in the Dark -- Dio

Another example:

Ride the Lightning -- Metallica

Lightning Strikes -- Ozzy Osbourne

Get it?

An additional note: we all know that song titles, sometimes, use profane words. Because this is a family friendly website it is advised that you clean up that title up a bit. This is accomplished by using something like sh!t instead of the real word. Thanks....

That is a misnomer. In the old days you subscribed to telephone service. That included the telephone line and one telephone. An extension cost $1 a month extra. So that $14,000 over 42 years was for the service not the leased telephone. There is no way they paid $28 a month for 42 years for a leased telephone.

This piece gets me - the fact that Dish has removed SD channels from satellite completely in the name of "HD upgrades". I pay for satellite TV, not streaming...I don't see why they couldn't leave the SD version of the channels on Satellite then put the HD streaming version like they have for other channels.
