The original patents that Bose has are from the 1970s, long past the 17 year mark.

Several companies offer headphones with active noise cancellation. I have a pair of Sennheiser PXC 450s (NoiseGard TM)that cut way down on fan noise.

Picking on companies that are in the news for other reasons is a great way to ride their wave.
