I was on travel much of last week and missed this one. To my surprise I didn't find it discussed anywhere in the forums. Anyway, to me it appears that Dish Network is practically conceding $328 million to Tivo for violating (comtempt) the court order by not disabling offending DVRs. Perhaps I am reading too much into the reporters brief comment, but this does not sound good for Dish Network.

"EchoStar is claiming the $975 million TiVo wants it to pay as sanctions for disobeying a federal court order is too high.

Instead, EchoStar’s lawyers gave U.S. District Judge David Folsom a figure of $328 million as their high-end figure and called TiVo’s proposed number “absurd” at a hearing Tuesday morning in downtown Texarkana.

Folsom ordered EchoStar to turn off the recording feature in millions of its digital video recorders after a jury found in 2006 the company was making big profits using software in them that infringed on TiVo’s patented “time warp” technology...."

The full story (Texarkana Gazette) requires a log-in by a paid print subscriber in order to view the entire article. This would be an interesting read since the trail and its ongoing coverage has been taking place in Texarkana.

The $328 million is pending the federal court appeal that will be heard this fall. If Dish wins that appeal then TIVO gets at most only a very small percentage of that if anything at all.

I could see thumbnails of the article (pages 1 and 10), but it was certainly too small to read. Anyway, this article was several paragraphs long and could be an interesting read because it appears to me the reporter was in the courtroom. Then again, it could have just been a summary of the entire case.
