here is all you gotta do.
send a registerted letter that you request return of equip. advised you will file in small claims court if equip is not turned over in X amount of day. (how many you feel is fair). if she does not turn recievers over, then file in small claims court for the retail costs of the equipment. if your husband is in contract and cannot cancel, then youalso file for all programming costs he is incurring that she does not pay.

it always helps to have already filled out the small claims court papers and send copies with the registered letter to show your intent to file.

This should have been taken care of in the settlement, division of property.
 
I bet he could contact the police dept and let them know that she has his property. As long as he can prove it (contract with model #s or serial #s) the law enforcement might be able to go to her house and seize the property. If that happens be sure to let the old neighbors know there might be some entertainment when the cops show up.
 
I think instead of borrowing trouble, it might be best to ask for them nicely the first time and not anticipate a refusal before it happens.

If they refuse (which the OP implies has already happened), then you step it up one notch at a time and do not kill a fly with a bazooka - perhaps a letter from the lawyer enumerating the possible penalties for refusal.

It is probably best to conduct these proceedings through third parties after the initial refusal.

Could be or it may be part of the division of property and it has already been paid for. The X just isn't playing nice. Surprise, surprise. I'm liking more & more the change the program package to foreign language one that she doesn't speak.
 
nah save money change to dish welcome or family pack. all trhat red in the guide will drive her nuts.

If he is paying, and is not required to, then I can't help but think the cheapest out is to close the account. Report what happened to Dish so maybe those boxes can't be used again, but be Real Careful about using the word "stolen."

Just put it behind you and move on. Or in the words of a woman I knew (who didn't follow her own advice): Build a bridge and get over it.
 
Get the Huspand and the Ex Wife on the phone and Dish will let you transfer it into her name to prevent the account from being disconnected. You need to get ahold of someone in executive offices to do this.

If you just shut it off in the middle of the night and if the Ex Wife wants to be a bitch about it you won't get the equipment back without a fight

Either you entered into a no-fault and everything was supposed to be settled before the filing or you itemize it as claimed property in a filing.

I'm with the previous people who said to kill the service and see if she surrenders the receivers. If not, paying the termination will be a heck of a lot cheaper than chasing this for months in court. He'd probably end up filing a judgement lien on her anyhow as she's not being very cooperative as it is.
 
If your husband wants to save his account, he must get his equipment back form the ex wife. He is reposnsible. His ex should do the right thing and surrender the equipment because it does not belong to her.
At this point the best thing to do (assuming his ex will not give up the equipment no matter what) is call Dish and cancel the account nad have Diosh shut off the receivers.
Then he must find a way to get the equipment from her. If she refuses, he can seek legal remedy through the judge that signed their divorce decree.
Or he can take her to small claims court. No need for a lawyer.
Or, he can tell Dish that his ex wife refuses to realease the receivers to him and that he will simply pay for them because it is cheaper than hiring a lawyer.
If he cancels his account , simply start one in your name.

If the ex doesn't comply then changing the programming. Cancel the programming an switch the programming to one of the adult channels.

Here's the rub. n a divorce once the decree and settlement are final, that's it. One party can not go back and take a second bite at the apple. If the sat equip,emt was not listed as property to go to the ex husband, he is out of luck. The police cannot do a thing. However if he can prove the equipment was to revert to him and she refuses to return it, then he has a civil matter. Not a criminal matter.
At this time, his first, best action is to attempt to retrieve that which is not hers to keep( Dish owns the equipment). Failing that he is well wihtunbg his rights to cancel his account or adjust the programming to a less desirable package, making the equpiment useless to the ex wife. He should also password protect the account AND alert the CSR to place notes that under no circumstances is anyone else authorized on the account.
This is a rule that Dish came up with years ago. Spouses cannot even sign paperwork in their own name.
 
She is ONLY keeping the equipment because the account is still active. Disable the account OR put it on 'summer' and she'll give the equipment back. If it isn't working she could care LESS about the equipment.... :)

If she is spiteful though she'll harm the equipment or still refuse to give it back.
