Still contractually locked into HD DVD exclusivity, DreamWorks Animation says it's up to Toshiba to decide when the company can begin releasing discs on Blu-ray.
That's according to DreamWorks Animation CEO Jeffrey Katzenberg, who acknowledged in an interview with Reuters Tuesday that his company was "well-compensated" for its HD DVD exclusivity, and that it was awaiting word from Toshiba on how to proceed.

It was very shortsighted of them to not have an "out clause" in case something like this happened. What is the point of releasing anything in HD-DVD now if most of your major stores are not going to carry them?

I wonder if they're obligated to actually release product, or they're obligated to release in HD-DVD IF they release any HD products. They could just not release anything in HD until their window of exclusivity has expired.

Gotta wonder- doesn't look like the Dreamworks lawyers did a good job. I guess Tosh wants some money back.

Paramount can stop the HDDVD production. Already mentioned by CEO of Dreamworks.

Note some of the rights are controlled by the producers/directors, notably Spielberg. Spielberg is said to have always insisted that he wanted his released on Blu-Ray.

Note that Dreamworks Animation was spun off earlier. And is not owned by Viacom(Paramount owners). But Paramount does do their distribution.

I think that you a re right on all counts. which means that paramount controls distribution of both of the companies using the Dreamworks name.
