I have an HP Media Center PC 883N. It came with a SD video card (http://www.emuzed.com/products_maui.html) . Is it possible to switch it out for an HD card and still use Microsoft's Media Center software?

Also...how does MS get away with using name based recording? Im surprised TiVo hasnt sued them yet.

You should be able to change it to an HD card but I do not know if you are going to be able to use the MS Media Center Software. Most of the HD cards in the market will have its own software. Also, the HD cards will only record OTA to your hard drive. You will not able to use it to connect to a satellite or cable feed.
