Good question...Can a open source software be hacked?
If you make the OS do things that Google would never approve due to the thread of being sued - probably yes...

I hear you but Goggle made it open source for this reason i though? Thus selling it fully unlocked and releasing new source code for people to use.

Well, Multitouch is an Apple patent.
On a corporate level a company would think twice before going for it.
Hence, to incorporate the feature because the OS is open-sourced could be called hacking...
VLC player... Plays everything... Open sourced...
By many execs' admissions it is considered a minefield of patent violations.
And those will be activated as soon as a business entity deploys it...

Whether it is hacking or not it sounds like youa re talking about using apple's IP. If that is the case that would be illegal regardless of whether you had to hack the phone or not.
I think the "crime" is limited to the word itself - multitouch.
With regard to claiming Apple invented the usage of more than one finger - it's not even funny...

you might want to reread my post in the context of waht it replied to. I never said that I bought apple's argument. What i was saying was that "hacking" was not what you should be worried about. What you should be worried about is apple trying to enforce their idea of what theft of IP is.
Well, everybody knows it's not a good idea to pi$$ off Apple legal department and they get pi$$ed off easily...
But that's no my worry, and never will be in the context of Nexus One.
For example, VLC plays MOV files (i.e. decodes its container) but was never the target of Apple "suits"...
