freaking TWC. they got a lot of heat from customers over this, and did this last month:

Without having to pay more, LMFAO. Oh, and if you do activate your own modem, they relinquish themselves of all liability. If there is ever an issue and you need tech support, get ready to be billed $$$$$.
There are 2 class action lawsuits going on over this, but doubt it will go anywhere.
