SatelliteGuys Makes The Court Case

Ok I havent read the entire document I just posted, but boy are these guys mincing words like crazy.

They harp on the fact that Dish promoted All American Direct on the special Charlie Chat, yet there is no mention whatsoever that Dish also mention people subscribe to cable or even (gasp) subscribe to DirecTV!

Dish made MILLIONS on Distant Networks each month, and now they are renting tranponder space for somewhere in the neighborhood of $150,000 a month to NPS. The one who is benefiting from this is NPS (All Amerian Satellite)

I feel what NPS is doing is LEGAL, and any attempts to thwart it is legilation against consumers not against Echostar.
 
We all have to remember who Greg is affiliated with. That's why he gets so angry with this subject.

Interesting that Satelliteguys got dragged into this, lol.
 
I am nowhere near the broadcast industry. I used to sell adversting for a non-profit's monthly magazine, but that is the only link I've had to the advertising industry.

Broadcasting was always a hobby.

I am curious as to why you are so against the freedom of choice, when you say that broadcasting is your hobby?

Now Jason, I don't ever recall Greg getting too angry about anything.:) In fact I wish he would get angrier sometimes.:)

What I do see is some people getting angry at the situation and then associating that anger with Greg. Maybe it's because he says it like he sees it and we don't like what we hear but keep in mind that his track record is exceptionally good in his areas of expertise.

Personally I'm pissed as hell over this whole mess. I'm now forced to watch VT LiLs that do things like replacing national programming at the drop of a hat. For instance this past August, they pre-empted a Pats exhibition game in favor of "paid programming" of which part was an hour long Bow-Flex commerical! My local Fox & ABC LiLs look like they're rebroadcasting off a VHS tape sometimes.

Where did you get that vibe Jason? I have always read his post as someone who reads the legal documents and posts his opinion of the legal standings in the case.

Jeez, I go to bed at midnight, turn on the TV, see the chat going on and immeditatly started recording, stay up till 3 doing the recap... get maybe 5 hours sleep and wake up to this... I wouldn't have done it if I had thought the NAB was going to use...

The only thing I would have done diffrently was watermarked the pictures with SatelliteGuys. :)

I wouldnt worry about it, it's all public record. As I said Dish can totally take the information and show how they mentioned Cable TV (explained how to get the basic Life Line Cable service) and even told people they could switch to DirecTV.

I actually was going to, but with the old program I was using(that I like) it didn't look right... I noticed they didn't mention the D*, Cable and antenna references... ;)

Wow. And people better be happy I have a thick skin.

If one of the reasons anyone believes this country is so great is because of freedom of choice, then everyone must understand that it is not only YOU that has that freedom of choice. These networks everyone so dearly loves have the choice to enter into exclusive franchise agreements.

So, contrary to many people's opinions, I am probably more for the freedom of choice than any of you are. Because some of you would most definitely prefer the government restrict someone else's freedom of choice.

And face it, if you give the government the power to restrict someone else's freedom of choice, then don't be surprised when your freedom of choice ends up being curtailed somewhere else down the road.
 
If I may contribute something, I have just read the emergency injunction, and although I'm not a lawyer, these are the two legal points they are trying to make:

"Defendants may not nullify a decree by carrying out prohibited acts through aiders and abettors, although they were not parties to the original proceeding"

"An instigator of contemptuous conduct may not absolve himself of contempt liability by leaving the physical performance of the forbidden conduct to others."

BUT, there is one HUGE FLAW in their logic:

The "prohibited act" here is NOT that E* CUSTOMERS should be barred from receiving Distant Broadcast signals.

The "prohibited act" is that E* is barred from PROVIDING these signals.

My opinion is, CBS, et al, YOU LOSE!
 
Scott, as the creator of the SatelliteGuys.US logo, I do not approve of its use in this fashion. Who do I sue for Copyright Infringement? CBS? Their attorneys? Did they ask you for permission to use your copyright materials in this fashion? Want to go halfsies?:D
