But I thought NPS was an independent company? If they cannot serve a "new" customer because this new customer is not a Dish Network customer, then there is definitely co-operation to co-opt the injunction, which is a no-no.

They can serve anyone apparently. The lady I spoke to today asked me who I had service through when I called.

BUT.....a different symphony then the one impugned by the courts.
NPS offers a stay of execution that will hopefully allow enough time for the Senate to pass what is just.
No court will be able to strike this down on previous merit.

Let's be real Greg, the way the Senate bill is written, it's not going to help most people that lost their distants. This NPS arrangement is a far better deal for most people.

E* is prohibited from providing DNS to anyone. However, E* subscribers are not prohibited from receiving DNS from a third-party. The networks and NAB's sole objection to this arrangement is the use of E* equipment and facilities - transponders, uplink, etc. Seems to me that the judge would have to expand the injunction to prohibit the use of any E* equipment for DNS including receivers. I don't think the judge has the authority to deny reception of DNS to qualified subscribers solely because they use E* receivers. E* may have lost the legal authority to transmit DNS to subscribers but E* subscribers' legal right to receive DNS, if they are qualified to, has not been taken away, yet.
